What are the differences between e-Government and UYAP (National Judicial Network)?

Entrance

With the digitalization of public services in Türkiye, citizens' relations with the state have become faster, more practical, and more transparent. While the e-Government Portal is one of the cornerstones of this transformation, the National Judicial Network Information System (UYAP) has been a key element in the modernization of judicial processes. Both systems offer digital public services, but they have significant differences in terms of purpose, function, scope, and legal consequences. This article will provide a detailed comparative analysis of what e-Government and UYAP are, what transactions can be performed, their legal frameworks, security features, and the most commonly confused aspects.

1. What is the e-Government Portal?

The e-Government Portal is a central digital key that enables citizens of the Republic of Turkey and foreigners to access all digital services of public institutions and organizations from a single platform.

Key Features

  • It houses more than 60 public institutions and thousands of different services.

  • Users can access all services with a single password.

  • Identity verification typically involves using an e-Government password, e-signature, or mobile signature.

  • It is open and accessible 24/7.

  • Services include social security, education, tax, land registry, traffic, criminal records, population registration, health, municipal services, and many more areas.

2. What is UYAP (National Judicial Network Information System)?

UYAP is an information network developed by the Ministry of Justice of the Republic of Turkey that enables judicial units (courts, prosecutor's offices, enforcement offices, forensic medicine, correctional institutions, lawyers, and citizens) to work together in an integrated electronic environment.

Key Features

  • It manages all judicial processes (lawsuits, enforcement proceedings, expert opinions, hearings, notifications, decisions, etc.) electronically.

  • UYAP has different user profiles, including a Citizen Portal, a lawyer portal, and an institutional portal.

  • All case files, court decisions, and enforcement proceedings can be tracked.

  • Electronic notification (e-notification), document sending, and online applications are among the available processes.

  • 24/7 access is provided.

  • Electronic Signature Law No. 5070

  • Notification Law No. 7201

5. The Difference Between Security and Personal Data Protection

Both systems prioritize the protection and security of personal data;
however, UYAP, being a purely judicial platform, is subject to stricter controls in terms of both encryption and access.

  • e-Government: Open to a wide audience; many services are for informational purposes, while some have official legal consequences.

  • UYAP: Contains sensitive and legal information accessible only to authorized personnel. All transactions are recorded and constitute legal evidence.

6. Frequently Asked Questions

Can I check my case file through e-Government?
Yes, you can basically see the case number, court, and hearing date. However, to access all the details, documents, and notifications of the case, you need to log in to the UYAP Citizen Portal.

Is an e-Government password sufficient to access UYAP?
Yes, you can access UYAP by verifying your identity using your e-Government password.

Is it possible to obtain land registry or population registration records through UYAP?
Access is only possible for records related to lawsuits and court proceedings. However, land registry/population registration records can be obtained directly and independently through e-Government.

Is there a difference in terms of their legal document status?
Some printouts from e-Government (such as criminal record certificates) are considered official documents, while most are for informational purposes only. Court decisions, notifications, and documents obtained from UYAP (National Judicial Network) are considered direct evidence.

7. UYAP and e-Government in Supreme Court and Council of State Decisions

The Court of Cassation and the Council of State explicitly accept that decisions and documents received electronically are legally valid if received in accordance with proper procedure. Electronic decisions, notifications, and file contents received via UYAP (National Judicial Network) gain official status with a digital signature or system verification code.

8. Conclusion and Practical Differences in Application

The e-Government Portal is a comprehensive platform where citizens can manage all their digital interactions with the state. UYAP, on the other hand, is a judicial portal that only opens to the judicial world, where litigation and enforcement processes can be managed. Although both systems are interconnected, direct access to the UYAP Citizen Portal is required for detailed judicial procedures. While the e-Government Portal may suffice for information and application processes, UYAP is the primary platform for the formal and evidence-requiring stages of legal processes.
