1. Yukos v. Russian Federation (PCA Case No. AA 227)

• Subject: Expropriation – Breach of Investment Agreement

The incident: Russia forced the giant oil company Yukos into bankruptcy through heavy tax audits and seized its assets. This action was seen by foreign investors as a violation of the Energy Charter Treaty and was taken to arbitration.

 2. Abaclat v. Argentine Republic (ICSID Case No. ARB/07/5)

 3. Salini v. Morocco (ICSID Case No. ARB/00/4)

Incident: Italian contractors claim that the Moroccan government has delayed payments for a highway project they are undertaking.

Decision: ICSID established the Salini Test , which defines the concept of "investment ." The definition of investment in arbitration proceedings was shaped by this decision.

4. Bulk Oil v. Sun International (ICC Case No. 5953)

• Subject: Payment delay in oil delivery

• Year: 1990s

Case: A Swiss oil company has filed for ICC arbitration, claiming that a Nigerian customer failed to pay after delivery of a shipment.

The decision: The court ruled to collect the $15 million debt. The case was concluded in just 5 months. ICC arbitration stood out in terms of speed and efficiency.

 5. Noble Energy v. Ecuador (ICSID Case No. ARB/05/12)

• Subject: Termination of energy investment contract

Case: A US investor claims that his investment in a power plant in Ecuador was unilaterally terminated by the government and has filed for investment arbitration.

Verdict: Ecuador was ordered to pay the investor $120 million in compensation . The decision clearly established that states cannot arbitrarily interfere in investor contracts.
