SUBJECT:

This is a request for the file awaiting review in the archive to be given priority and for the process to be completed within a reasonable timeframe.

EXPLANATIONS:

1. My client's file was returned to the local court for the correction of deficiencies identified by the relevant court , and after the necessary corrections were made, it was sent again to the Supreme Court Chief Public Prosecutor's Office . However, we have determined that the file has been sitting in the archives for a long time.
2. Article 141, paragraph 3 of the Constitution of the Republic of Turkeystipulates that one of the fundamental duties of the judiciary is to ensure that cases are concluded as quickly and inexpensively as possible. Similarly, Article 6, paragraph 1 of the European Convention on Human Rights guarantees that judicial proceedings shall be completed within a reasonable time.
3. Article 40 of the Supreme Court Law No. 2797 and Article 141 of the Criminal Procedure Code , it is essential that the investigation and prosecution phases without unnecessary delays . Delayed justice undermines confidence in the judicial process and restricts the client's right to seek justice.
4. My client is suffering serious hardship due to the case remaining in the archives . The failure to reach a decision within a reasonable time is incompatible with the fundamental principles of law. In accordance with the right to a fair trial , it has become imperative that our case be examined as a matter of priority.

CONCLUSION and REQUEST:

Taking into consideration the matters presented and explained above, I respectfully request and demand that our file, which is awaiting review in the archives of the Supreme Court Chief Public Prosecutor's Office , be examined as a priority and concluded within a reasonable time
