Petition for Assessment of Damages Caused by an Accident

SUBJECT : Request for assessment of the damage and decrease in value of my client's vehicle due to the accident.

EXPLANATIONS :

1. On January 1, 2000, a traffic accident resulting in material damage occurred when the vehicle with registration number [01 ABC 123], driven by [driver's name], collided with the vehicle with registration number [34 XYZ 456] belonging to our client. [XYZ Insurance Inc.], which we have named as the defendant, also provided compulsory financial liability insurance for the other party's vehicle.
2. The traffic accident report states that the other driver was 100% at fault and that my client was not at fault in the accident. My client's vehicle was in good condition and had undergone regular maintenance prior to the accident. However, the resulting decrease in the vehicle's value has caused my client significant financial loss.
3. We request that the damage and depreciation in value of our vehicle be assessed by an expert appraiser as a basis for the debt collection lawsuit we will be filing against the other party. This assessment is also important in terms of potential additional damages and possible long-term effects that may arise in the future. For these reasons, it has become necessary to file this lawsuit in your court.

EVIDENCE : 1- Expert examination of the vehicle, 2- Traffic Accident Report and all other relevant evidence.

LEGAL GROUNDS : Provisions of the Highway Traffic Law and related legislation.

CONCLUSION AND REQUEST : For the reasons briefly explained above, we respectfully request and demand that the court order an on-site assessment to determine the damage and depreciation in value of the vehicle by an expert appraiser, and that the court costs and attorney's fees be borne by the opposing party.
