Home Care Services Contract

HOME CARE SERVICES AGREEMENT

PARTIES This agreement is entered into between the SERVICE PROVIDER , residing at ……………………………………. address , and the SERVICE RECIPIENT , residing at ……………………………………. address , under the following terms and conditions


SUBJECT

ARTICLE 1 – The subject of this agreement is the provision of home care services (elderly/disabled/sick care, support in daily living activities, etc.) by the Service Provider to the Service Recipient or their relatives, and the determination of the mutual rights and obligations of the parties.


SERVICE PROVIDER'S OBLIGATIONS

ARTICLE 2 –
2.1. To perform care services with care and attention, taking into account the needs of the Service Recipient.
2.2. To act in accordance with health legislation and ethical rules.
2.3. To keep the personal information of the Service Recipient confidential and not to share it with third parties.
2.4. To be responsible for the hygiene of materials and equipment used during the service.


SERVICE RECIPIENT'S OBLIGATIONS

ARTICLE 3 –
3.1. To provide accurate and complete information necessary for the smooth running of the service.
3.2. To provide a suitable working environment for the Service Provider.
3.3. To pay the agreed service fee on time.
3.4. To refrain from actions that would jeopardize the Service Provider's occupational safety.


FEES AND PAYMENTS

ARTICLE 4 –
4.1. The monthly fee for the service is …………… TL + VAT.
4.2. Payment will be made in advance on … days of each month.
4.3. In case of non-payment, the Service Provider has the right to suspend the service.


DURATION AND TERMINATION

ARTICLE 5 –
5.1. This agreement commences on …/…/… and is valid for a period of … months.
5.2. If either party fails to fulfill its obligations, the other party may terminate the agreement by written notice.
5.3. If the Service Recipient terminates the agreement without just cause, it is obligated to pay the fee for the remaining period.


LIMIT OF LIABILITY

ARTICLE 6 – The Service Provider may only provide first aid in situations requiring medical intervention; it is not responsible for treatment. In such cases, the healthcare facility shall be notified as soon as possible.


COMPETENT COURT

ARTICLE 7 – In case of disputes arising from this agreement, the Courts and Enforcement Offices of …………… shall have jurisdiction.
