As a natural consequence of the principle of sovereignty, the jurisdiction of states is, as a rule, limited to their territorial borders. Therefore, a court decision rendered in one country cannot be directly enforced in another. For foreign court decisions to have legal effect in a different state's territory, the procedures prescribed in the domestic law of that state must be fulfilled.

The long-standing and intensive economic, commercial, and social relations between Turkey and France have made the enforcement of French court judgments in Türkiye a significant necessity. Commercial disputes between companies operating in France and Turkish companies, family law cases involving Turkish citizens residing in France, inheritance disputes, or debt claims arising from contracts are among the primary examples requiring the enforcement of foreign court judgments in Türkiye.

For example, a debt judgment issued by the Paris Commercial Court against a Turkish company can only be enforced after fulfilling the procedures stipulated by Turkish law, provided the debtor's assets are located in Türkiye. Similarly, the collection of alimony or monetary compensation awarded in a divorce case heard in France in Türkiye also depends on the fulfillment of certain legal conditions. Therefore, the finality of a foreign court judgment alone is not sufficient; the enforcement process must also be completed under Turkish law.

French Court Decisions Gaining Legal Validity in Türkiye

While a court decision issued in France is binding and enforceable in that country, it does not automatically have the same effect in Turkey. The fundamental reason for this is that each state has sovereign authority to determine which court decisions will be implemented within its own territory.

In Turkish law, the recognition and enforcement of foreign court judgments are subject to the provisions of Law No. 5718 on International Private Law and Procedural Law. This law regulates in detail the conditions under which foreign court judgments will have legal effect in Türkiye.

The purpose of the enforcement proceedings is not to resolve the dispute a second time, but to determine whether there is any obstacle to the application of the foreign court decision under Turkish law. Therefore, enforcement proceedings have a completely different legal character from the main case.

Which French court decisions are enforceable?

Not every judgment rendered by French courts can be enforced in Türkiye. The legislator only permits the enforcement of judgments relating to private law and that are enforceable.

The most common enforcement requests in practice relate to commercial debt cases, compensation judgments arising from breach of contract, alimony rulings in family law, certain decisions arising from inheritance law, and commercial disputes between companies.

In contrast, prison sentences or public law sanctions imposed by criminal courts are not considered within the same scope. This is because such decisions are directly related to the sovereign authority of the state.

Determining whether a decision is enforceable is one of the first and most important stages of a lawsuit. A lawsuit filed regarding a decision that is not enforceable will be dismissed, even if other conditions are met.

Limits of the Turkish Court's Jurisdiction in Enforcement Review

One of the most important principles regarding the enforcement of foreign court judgments is that the merits of a foreign court judgment cannot be re-examined.

According to this principle, the Turkish judge does not investigate whether the French court applied the law correctly. Whether the evidence is sufficiency, the accuracy of witness statements, or the correctness of expert reports are not the subject of the enforcement proceedings.

For example, a French court may have awarded compensation on the grounds of breach of contract. The defendant cannot request a review of the decision by a Turkish court, claiming that the French court misjudged the evidence or made a flawed legal interpretation. This is because an enforcement action is not a second appeal or review process.

Turkish courts only examine whether the conditions stipulated in the law have been met. This ensures both respect for foreign court decisions and the protection of the fundamental principles of the Turkish legal system.

Evaluation of Enforcement Conditions

For French court judgments to be enforceable in Türkiye, they must first be final. Judgments that are not final or for which ordinary legal remedies have not yet been exhausted cannot be enforced. Therefore, it is mandatory to include documents demonstrating the finality of the foreign court judgment in the case file.

Furthermore, the decision must relate to private law. Sanctions arising from public law or many decisions of criminal courts are outside the scope of enforcement.

Another issue considered by the court is public order. Decisions that severely violate the fundamental principles of Turkish law or are incompatible with the right to a fair trial are not permitted to be implemented in Türkiye. However, the mere fact that French law produces different results than Turkish law is not considered a violation of public order. The public order exception is a narrowly interpreted protection mechanism applied only in exceptional circumstances.

Furthermore, ensuring the defendant's right to defense is of paramount importance. The court may reject the enforcement request if the lawsuit is not properly notified, the party is not informed of the proceedings, or the defendant's ability to defend themselves is eliminated. Conversely, if the defendant, despite being duly summoned, voluntarily fails to appear at the proceedings, this alone does not constitute an obstacle to enforcement.

Another important point is whether the dispute falls within the exclusive jurisdiction of Turkish courts. If a French court has ruled on a dispute that, by law, should only be heard in Turkish courts, that ruling may not be enforceable in Türkiye. Therefore, jurisdiction rules must be evaluated separately for each specific case.

Filing an Enforcement Proceeding and the Legal Process to be Followed

For a French court judgment to be enforceable in Türkiye, an enforcement action must be filed with the competent Turkish court. An enforcement action is not a legal review of a foreign court judgment, but rather a specialized type of litigation to determine whether there are any obstacles to the application of the judgment within the Turkish legal system.

When filing a lawsuit, it is essential to clearly state which court issued the court decision whose enforcement is sought, the date the decision became final, which provisions of the decision are desired to be enforced in Türkiye, and the legal basis for the request. This is particularly important when only specific parts of the decision are requested to be enforced, as it must clearly indicate the provisions in question without any ambiguity.

The court first assesses, based on the evidence presented by the parties and the documents in the case file, whether the enforcement conditions stipulated by law have been met. If it is determined that the conditions exist, the court decides that the foreign court decision is enforceable in Türkiye.

Why is Document Preparation So Important?

One of the most significant reasons for the delays in enforcement proceedings is the deficiencies in the documents submitted to the case file. However, preparing all necessary documents completely before filing the lawsuit can contribute to a faster completion of the trial process.

A duly prepared copy of the French court's decision, the document proving the finality of the decision, and Turkish translations of any foreign-language documents constitute the essential elements of the case file. It is also important that information such as names, dates, or decision numbers in these documents corroborate each other. Even seemingly minor discrepancies in information may lead the court to request further clarification.

One of the important points to consider is that official documents must have completed the necessary authentication procedures in order to be used in Türkiye. Prolonged legal proceedings due to incomplete authentication or improperly prepared documents are common problems encountered in practice.

The Consequences in Türkiye of Divorce Decrees Issued by French Courts

Divorce cases are among the most common legal issues faced by Turkish citizens living in France. However, the consequences of a divorce decree in Türkiye can vary depending on the content of the decree.

Provisions regarding alimony, monetary compensation, moral damages, or court costs in a divorce decree do not have the same legal nature. The legal effect of the part of the decree concerning the dissolution of the marriage in Türkiye and the enforcement of its financial consequences through compulsory execution in Türkiye may be subject to different legal procedures.

For example, if a child support payment ordered in France is to be collected in Türkiye, the mere existence of the decision will not be sufficient; the necessary legal process must be completed for the decision to become enforceable in Türkiye.

Therefore, when evaluating foreign court decisions regarding family law, the scope of the decision should be carefully examined and it should be correctly determined which provisions are intended to be applied in Türkiye.

The Importance of Enforcement in Commercial Disputes

The development of economic relations between France and Türkiye is also increasing the number of foreign court judgments stemming from commercial disputes.

Decisions rendered by French courts in disputes arising from international sales contracts, distribution relationships, transportation contracts, works contracts, and various commercial collaborations may need to be enforced in Türkiye.

For example, a French company may have won a lawsuit against a business operating in Türkiye. However, because the debtor's assets are located in Türkiye, the judgment can only be effectively enforced with an enforcement order from a Turkish court.

In this respect, the institution of enforcement is one of the important legal mechanisms that ensures the effective implementation of court decisions in international trade life.

Why is a Public Order Review Important?

The concept of public order is one of the most debated issues in the enforcement of foreign court judgments.

The Turkish court does not reassess the content of the French court's decision. However, it is obliged to examine whether the implementation of the decision clearly contradicts the fundamental values ​​of the Turkish legal system.

The point to note here is that the concept of public order is applied in a highly exceptional manner. The fact that a solution adopted in French law differs from that in Turkish law is not, in itself, sufficient grounds for rejecting the enforcement request.

However, the public order exception may apply to decisions that severely violate fundamental rights and freedoms, eliminate the right to defense, or clearly undermine the principle of a fair trial.

This approach both preserves confidence in foreign court decisions and prevents the violation of the fundamental principles of the Turkish legal system.

Problems Encountered in Practice

The problems encountered in the enforcement of French court judgments are mostly procedural.

In particular, the failure to include the document proving the finality of the decision in the file, factual errors in translations, inconsistencies in party information, or the incomplete submission of the decision can prolong the judicial process.

In some cases, even if only certain provisions of a foreign court decision are sought to be enforced, the court may request additional clarification because this is not explicitly stated in the petition.

In international disputes, careful preparation of documents and attention to procedural details are crucial to preventing future loss of rights.

The Supreme Court's Approach to French Court Decisions

An examination of the Supreme Court's decisions regarding the enforcement of foreign court judgments reveals that, with regard to French courts, the general principles set forth in Law No. 5718 on International Private Law and Procedural Law are applied rather than a specific assessment.

The Court of Cassation does not consider it legally possible to examine the merits of a foreign court's decision; it accepts that the review should be limited solely to the conditions for enforcement. In line with this approach, how the foreign court evaluated the evidence or what conclusions it reached regarding the factual circumstances are not the subject of the enforcement review.

Furthermore, the established view that the public order exception should be interpreted narrowly is also important in the enforcement of French court decisions. This ensures that enforcement requests are only rejected in cases where the violation is genuinely serious.

Conclusion

For judgments rendered by French courts to have legal effect in Türkiye, they generally depend on an enforcement decision issued by Turkish courts. The finality of a foreign court judgment alone is not sufficient; all conditions stipulated in Turkish law must also be fully met.

In enforcement proceedings, the Turkish court does not re-examine the French court's decision; it only assesses whether there are legal grounds that could prevent the decision from being implemented in Türkiye. This system aims to support international legal certainty on the one hand, and to protect the fundamental principles of the Turkish legal order on the other.

Given the intensity of trade relations between France and Turkey, as well as disputes arising from family and inheritance law and international agreements between citizens residing in both countries, the enforcement of French court judgments in Türkiye holds significant importance in practice. Ensuring that the process is conducted in accordance with procedural rules, that all necessary documents are prepared completely, and that the scope of the foreign court judgment is correctly assessed are crucial in preventing loss of rights and ensuring the effective implementation of the judgment in Türkiye.
