Warning and Notification of Legal Rights Regarding the Use of Materials Contrary to Contract Terms in Construction

EXPLANATIONS:

1. My client is the landowner and has entered into a construction and sales promise agreement with the contractor , dated …/…/… and numbered …, at the … Notary Public. According to the agreement, the contractor is obligated to construct independent units on the land registered under title deed number … belonging to my client, in accordance with the terms of the agreement .
2. Inspections revealed that the materials used in the construction did not meet the standards specified in the contract and that substandard materials were used . The use of low-quality materials degrades the quality of the work and fails to meet the client's legitimate expectations. This clearly demonstrates that the contractor acted in breach of its contractual obligations.
3. According to the contract, my client demands that the work be completed in accordance with the contract terms. Therefore, all materials used outside the standards stipulated in the contract be removed and replaced with materials of appropriate quality . Otherwise, that our client will not hesitate to exercise its legal rights, the work will not be accepted, and all legal avenues, including termination of the contract, will be pursued.
4. You are given thirty (30) days to make the relevant corrections . Please be informed that if the necessary changes are not made within this period , legal action will be taken to recover from you the damages incurred due to the non-completion of the construction, as well as claims for material and moral damages .
