The Impact of UEFA and FIFA Decisions on Turkish Law

In international sports governance, decisions by FIFA (Fédération Internationale de Football Association) and UEFA (Union of European Football Associations) not only determine sporting regulations but also direct legal consequences . For national federations that are members of FIFA and UEFA, such as Turkey, the fundamental question in their legal systems is:
To what extent are these decisions binding under Turkish law, and through what mechanisms are they enforced?


1. Normative Framework: The International Connection and Legal Position of the Turkish Football Federation (TFF)

The Turkish Football Federation (TFF) is regulated as an autonomous public institution by Law No. 5894 on the Establishment and Duties of the Turkish Football Federation . Article 3 of this law explicitly states that "The TFF is obliged to comply with the rules of FIFA and UEFA." This statement shows that the TFF accepts the obligation to comply with international norms at the legal level

Therefore, FIFA and UEFA regulations are not merely internal regulations; a mandatory compliance requirement stemming from law .
The Turkish Football Federation's Statutes and Regulations (Disciplinary Regulations, Club Licensing Regulations, Ethics Regulations, Football Agents Regulations, etc.) incorporate local reflections of these norms.

Thus, Turkish sports law a dual structure :

  1. National law (legal and judicial system),

  2. International sports law (FIFA–UEFA–CAS system).

There is not a normative hierarchy but a functional unity between these two systems ; that is, the Turkish Football Federation (TFF) is, on the one hand, part of Turkish law, and on the other hand, an organic extension of the FIFA and UEFA systems.


2. Sources and Types of FIFA and UEFA Decisions

FIFA and UEFA decisions generally fall into three categories:

  1. Normative decisions: These are general regulations such as statutes, directives, regulations, licensing criteria, and financial fair play.

  2. Disciplinary decisions: Sanctions imposed on clubs, players, or federations (transfer bans, suspensions, fines).

  3. Judicial decisions of the FIFA Football Tribunal (Dispute Resolution Chamber, Players' Status Chamber, Agents Chamber) and the CAS (Court of Arbitration for Sport) .

Among these decisions, the impact of disciplinary and judicial decisions on Turkish lawis the most debated issue in practice.


3. Scope of Application: TFF's Authority to Comply and Enforce

The link between FIFA and UEFA decisions and their implementation in Turkey is established through the Turkish Football Federation's (TFF) membership and compliance commitment . Each year, the TFF submits a declaration at the FIFA and UEFA congresses accepting its membership obligations . Accordingly, the TFF and its affiliated clubs, players, and administrators are considered to have committed to complying with FIFA and UEFA rules .

Article 59 of the TFF Statutes clearly regulates this:
"Compliance with the decisions of FIFA and UEFA and the rulings of the Court of Arbitration for Sport (CAS) is mandatory."

Therefore, as a national federation, the TFF (Turkish Football Federation) is obliged to implement decisions taken by FIFA or UEFA at the national level . This often takes the form of a direct administrative action or disciplinary decision

  • If a Turkish club is given a transfer ban by the FIFA Disciplinary Committee, the Turkish Football Federation (TFF) enforces this ban according to the TFF Transfer Regulations and suspends the licensing process.

  • If UEFA bans Turkey from European competitions due to a Financial Fair Play violation, the Turkish Football Federation (TFF) will incorporate this into its local registration and licensing system.


4. Recognition of International Judgments in Turkish Courts

FIFA or UEFA decisions cannot be directly enforced by Turkish courts because they are not decisions of the state judiciary, but of autonomous sports law bodies.

  1. Implementation via TFF:
    The TFF enforces the relevant decision at the national level (e.g., registers the transfer ban in the system).

The recognition of CAS awards is the most common example in this context.
The decision of the 11th Civil Chamber of the Court of Cassation, numbered 2017/4358 E., 2019/2211 K., serves as a precedent in this regard:
“CAS awards are arbitral in nature and can be recognized in Turkey according to the provisions of the Private International Law Act; because the parties have explicitly accepted the arbitration jurisdiction.”


5. Arbitration-Judicial Relationship: TFF Arbitration Board and CAS

In Turkish sports law, the judicial structure consists of three layers:

  • Disciplinary Boards (first instance),

  • TFF Arbitration Board (appellate body),

  • CAS (Court of Arbitration for Sport) (international appeals court).

Decisions of the TFF Arbitration Board are final and not subject to judicial review (Law No. 5894, Article 6/5).
This has also been found by the Constitutional Court to be consistent with the principle of "autonomy of sport" in Article 59 of the Constitution.
However, the TFF Arbitration Board is only the final authority for internal TFF disputes; appeals to CAS against FIFA-UEFA decisions are possible.

For example, a decision of the FIFA Football Tribunal (such as a contract termination or compensation decision) can be appealed to the CAS within 21 days . For this decision to be enforceable in Turkey, it must be notified to the TFF (Turkish Football Federation) and executed in accordance with the TFF Disciplinary Regulations . Therefore, CAS decisions indirectly acquire enforceability under Turkish law as well.


6. The Limit of Public Order and the Supervision of Turkish Courts

Although FIFA and UEFA decisions are binding, Turkish courts can review these decisions public order .
For example, if a CAS decision is clearly contrary to Turkish public order, the court may refuse to recognize it.

7. Applicability of Disciplinary and Financial Sanctions

The most tangible impact of UEFA and FIFA decisions is seen through disciplinary sanctions . UEFA's Financial Fair Play (FFP) rules were developed to ensure the financial sustainability of clubs. If Turkish clubs exceed their income-expenditure balance, they will face sanctions from UEFA.

  • Ban from European competitions,

  • Transfer ban,

  • Salary restrictions or

  • They may face a fine.

These decisions are reported directly to the Turkish Football Federation (TFF) and incorporated into the national licensing system by the TFF . The club cannot have this sanction lifted through an "annulment lawsuit in Turkish administrative courts," as the TFF enforces this decision as an international obligation . However, the club can appeal to the UEFA Appeals Body or the Court of Arbitration for Sport (CAS)

However, for FIFA Football Tribunal decisions involving compensation or receivables, the TFF (Turkish Football Federation) is merely the enforcement mechanism . If the decision is not complied with, the FIFA Disciplinary Committee imposes sanctions on the club, such as point deductions, transfer bans, or relegation ; the TFF then effectively implements this decision in Turkey .


8. The Need for Reform in Turkish Sports Law

Although the Turkish Football Federation (TFF) and Turkish courts largely implement FIFA-UEFA decisions, some structural gaps exist:

  • The recognition and enforcement processes for FIFA or CAS decisions are lengthy.

  • Turkish athletes and clubs their right to a fair trial .

  • Contradictions may arise regarding the compatibility of disciplinary penalties with domestic law .

  • UEFA FFP decisions sometimes corporate auditing norms in Turkish law.

Therefore, the TFF's legal regulations should be made more systematic and predictable ; a specific clause regarding the recognition of CAS decisions should be added (for example, a "CAS compliance protocol in the TFF Arbitration Statute")


9. Conclusion and Evaluation

UEFA and FIFA decisions are considered international federative norms directly applicable under Turkish law . The Turkish Football Federation (TFF) implements and enforces these decisions at the national level based on its legal authority. However, this does not mean that state jurisdiction is completely excluded ; Turkish courts retain indirect supervisory authority within the limits of public order and arbitration law

Autonomy is inherent in sports law; however, autonomy does not conflict with the rule of law.
Therefore, FIFA and UEFA decisions are applicable in the Turkish legal system:

  • Binding through TFF (Turkish Football Federation),

  • CAS decisions are subject to appeal,

  • Recognizable within the framework of the Private International Law Act,

  • It establishes a normative order , limited by public order

Given the universal nature of sport, the enforceability of international federation decisions under Turkish law is a matter of balance, not only from the perspective of sporting discipline but also in terms of compliance with universal principles of law . This balance ensures both the international integrity of sport and the sovereignty of national law.
