TERMINATION OF USUFRUCT RIGHTS

Termination of Usufruct Rights: Article 796 and its Application

1.1. Termination of Fixed-Term Usufruct Rights

If a usufruct right is established for a specific period, it terminates when that period expires. This is the most common reason for termination. The start and end of the period are determined by contract, or in cases arising from law, a statutory period applies.

Upon the termination of a temporary usufruct right, the usufructuary loses the right to use the property, while the owner acquires full control over it. In this case, the usufructuary has no remaining rights over the property.

The important point is that if the usufructuary abuses their rights or damages the property before the term expires, the property owner can apply to the court to request the termination of the rights.

1.2. Death of the Usufructuary

The most fundamental reason for the termination of lifelong usufruct rights is the death of the usufruct holder. Upon death, the usufruct right ends, and the right reverts to the owner.

However, usufruct rights can be inherited. In this case, whether the usufruct right terminates or not depends on how the usufruct right was established and the terms of the contract between the parties. Usufruct rights passed down to heirs can lead to complex legal disputes regarding whether the usufruct right is for a fixed period or not.

1.3. Loss or Invalidation of the Goods

Since usufruct is the right to use and benefit from a property, the complete destruction, damage, or rendering of the property unusable leads to the termination of the usufruct right.

For example, the complete destruction of a property due to a natural disaster terminates the usufruct right. In this case, the usufruct holder can no longer use or benefit from the property.

The fault and responsibility of the parties are important in cases of damage to property. Damages resulting from the fault of the property owner or usufructuary may affect the termination process of rights and give rise to claims for compensation.

1.4. Waiver of Rights by the Usufructuary

The usufructuary may voluntarily relinquish their right. This relinquishment must be made clearly and unequivocally. The declaration of relinquishment may be verbal or in writing, but in practice, it is preferred that it be in writing and recorded in the land registry for security reasons.

Waiver terminates the usufruct right, and the owner acquires full control over the property. The waiver is legally binding on the right holder and cannot be revoked.

1.5. Termination of Usufruct Rights by Court Decision

In some cases, a usufruct right can be terminated by a court order if the holder fails to fulfill their obligations, misuses the property, or breaches the contract.

The property owner may request the termination of usufruct rights due to the conduct of the usufructuary. If the court, based on the evidence, concludes that the usufruct right has been abused, it may decide to terminate the right.

This situation plays an important role within the protection and control mechanisms of usufruct rights and ensures a balance of the parties' rights.


2. Legal Consequences of the Termination of Usufruct Rights

2.1. Loss of Rights and Obligations of the Usufructuary

When a usufruct right expires, the usufructuary loses the right to use or benefit from the property. They no longer possess any real rights over the property and are obligated to return it to the owner.

The delivery of the property is the most fundamental obligation of the usufructuary. If the property is not delivered, the owner can apply to the court to demand its return. Furthermore, compensation claims may arise in cases of unauthorized use and damage to the property.

2.2. Expansion of Property Owner's Rights

The termination of a usufruct right means that the owner's power to dispose of the property expands. When the usufruct right ends, the owner can freely use, sell, mortgage, or transfer the property to third parties.

This means that the owner's rights are fully restored and they can exercise their rights to dispose of the property without restriction.

2.3. The Situation from the Perspective of Third Parties

If the usufruct right has been registered in the land registry, its termination is announced upon the cancellation of this registration, thus declaring the rights terminated against third parties as well. In this way, third parties learn that they no longer have a usufruct right over the property and can easily conduct their legal transactions with the property owner.


3. Disputes That May Arise Upon Termination of Usufruct Rights and How to Resolve Them

3.1. Disputes in Time Calculation

In fixed-term usufruct rights, disputes may arise regarding the start and end of the term. For example, the precise determination of the date of establishment of the usufruct right or the interpretation of the term specified in the contract may lead to different results.

In such cases, courts determine the start and end dates of the term by taking into account the purpose of the contract, the intentions of the parties, and legal provisions.

3.2. Whether the Usufruct Right Passes to the Heirs

Whether the usufruct right passes to the heirs after the death of the usufructuary is a significant point of contention between the parties. If the contract does not explicitly state that the usufruct right passes to the heirs, the right generally terminates upon death.

Issues such as the continuation of usufruct rights among heirs, rejection of inheritance, and inheritance distribution can create serious legal problems.

3.3. Liabilities in Case of Damage to Property

In cases of property damage, the fault and responsibility of both the usufructuary and the property owner must be determined. If the usufructuary has misused or damaged the property, the property owner has the right to claim compensation.

If the cause of destruction is a natural disaster, the parties' responsibilities may change, and the termination of the usufruct right may be interpreted differently.

3.4. Abuse of Usufruct Rights and Legal Sanctions

If the usufructuary uses the property for purposes other than its intended use or causes damage to it, the property owner may request the court to terminate the usufruct right. If the court determines that abuse has occurred, it will order the termination of the usufruct right.

This sanction protects the rights of the property owner while increasing the responsibilities of the usufructuary.
