Termination of Contracts in CAS Decisions

One of the most controversial areas of international sports law is the termination of athlete contracts and the principle of contractual stability applied in this context . Contracts between professional athletes, clubs, and agents are evaluated not only under labor law but also within a special sports law regime. In this regard, the Court of Arbitration for Sport (CAS) stands out as one of the most competent bodies in resolving disputes between athletes and clubs.

The precedents set by CAS regarding athlete contracts are influential in both the development of international sports law and national regulations. In particular, the principle of contractual stability and the sanctions to be applied in case of its violation are shaped by FIFA regulations and CAS decisions.

  • CAS 2008/A/1519 & 1520 (Matuzalem Decision):
    The court awarded Brazilian footballer Matuzalem a very high amount of compensation for unfairly terminating his contract, and also imposed a transfer ban, making it one of the most striking examples of contractual stability.

  • CAS 2016/A/4474:
    The long period of absence from playing time for the athlete was accepted as a justifiable sporting reason; however, it was decided that the athlete should be paid compensation.

  • CAS 2019/A/6301:
    The club's persistent delays in salary payments were deemed grounds for justified termination. The player was released, and the club was ordered to pay compensation.

These decisions have clarified the rights and obligations of both clubs and athletes.


Athlete Contracts and CAS from the Perspective of Turkish Law

In Turkey, athlete contracts are generally considered service contracts within the framework of the Turkish Code of Obligations (TBK) . However, for footballers, the Turkish Football Federation's Regulations on the Status and Transfers of Professional Footballers also apply.

The principle of contractual stability has also been accepted in Turkish law. In particular, of the Turkish Football Federation's Dispute Resolution Board (DRB) and Arbitration Board are implemented in parallel with CAS jurisprudence. While athletes are granted the right to terminate contracts for just cause in cases of non-payment of wages, arbitrary terminations are subject to sanctions such as compensation and license revocation.

Furthermore, since Türkiye is a member federation of FIFA, CAS decisions are also binding on Turkish clubs.


The Importance of Contractual Stability from the Perspective of Sports Law

Ensuring stability in athlete contracts protects not only the interests of the parties, but also:

  • Balance of competition,

  • The financial structure of the clubs,

  • It is also vital for preserving the integrity of sport

Otherwise, clubs could victimize athletes through arbitrary contract terminations, and athletes could easily breach their contracts for more attractive offers. In this case, both legal security and the sporting order would suffer.

  1. Disseminating CAS Decisions: Clubs and athletes should become more familiar with CAS case law and consider these decisions when drafting contracts.

  2. National and International Harmonization: The Turkish Football Federation's regulations must be brought into full compliance with FIFA and CAS decisions.

  3. Transparent Contracts: Secret supplementary protocols must be prevented, and all payments must be reflected in official contracts.

  4. Education and Awareness: Athletes and managers should be informed about the severe penalties they will face if they violate the principle of contractual stability.

  5. Expediting Arbitration Processes: CAS and national sports arbitration bodies should resolve disputes more quickly.
