Sample Real Estate Lease Agreement

REAL ESTATE LEASE AGREEMENT

PARTIES On one side, …………………………… residing at …………………………… address, Turkish Republic Identity No: …………………………… (hereinafter referred to as “LESSOR” ), on the other side, …………………………… residing at …………………………… address, Turkish Republic Identity No: …………………………… (hereinafter referred to as “TENANT” ), have entered into this Real Estate Lease Agreement under the terms and conditions stated below.



ARTICLE 1 – SUBJECT

The subject of this agreement is the transfer of the right to use the immovable property owned by the Lessor, located at …………………………… address and registered in the land registry as …………………………… (“LESSEE”), to the Lessee in exchange for rent.


ARTICLE 2 – RENTAL FEE AND PAYMENT

2.1. The tenant shall pay ……………… TL (……………… Turkish Lira) as monthly rent under this agreement . 2.2. The rent shall be paid in advance on ……… day of each month to the Landlord's account at …………………………… Bank, IBAN number …………………………… 2.3. If the tenant fails to pay the rent on time, they agree to pay a monthly late payment interest of %……


ARTICLE 3 – DEPOSIT

3.1. The Tenant agrees to pay the Landlord a security deposit of ……………… TL upon signing this agreement. 3.2. The deposit will be returned to the Tenant upon the eviction of the rented property and provided there is no damage to the property. 3.3. The deposit may be offset against any unpaid rent owed by the Landlord or compensation for damage to the property.


ARTICLE 4 – DELIVERY AND USE OF THE LEASED PROPERTY

4.1. The leased property will be delivered to the Tenant on ……/……/………
4.2. The Tenant shall use the property with care and respect neighborly relations.
4.3. Maintenance, repairs, and alterations to the leased property are subject to the Landlord's written approval.
4.4. The Tenant may not transfer or sublet the leased property to third parties without the Landlord's permission.


ARTICLE 5 – EXPENSES AND TAXES

5.1. Utility expenses such as electricity, water, natural gas, and maintenance fees for the property are the responsibility of the Tenant.
5.2. Property tax and building insurance for the property are the responsibility of the Landlord.
5.3. Common area maintenance fees will be paid regularly by the Tenant.


ARTICLE 6 – STATEMENTS AND COMMITMENTS OF THE PARTIES

Landlord's Commitments:

  • To deliver the rented property in a usable condition

  • To ensure the tenant's peaceful use of the premises throughout the contract period

  • Performing repairs required by law.

Tenant's Commitments:

  • Not to use the rented property for purposes other than its intended use

  • Paying rent on time,

  • To avoid damaging the property and to return it in the same condition as it was received upon eviction

  • Not to transfer the leased property to third parties.


ARTICLE 7 – DURATION AND TERMINATION

7.1. This agreement shall commence on ………/………/……… and shall be valid for a period of ……………… years . 7.2. If either party wishes to terminate the agreement, it must provide written notice at least ……………… months prior to the termination date. 7.3. If the tenant fails to pay the rent for ……………… months consecutively, the Landlord may unilaterally terminate the agreement.


ARTICLE 8 – MISCELLANEOUS PROVISIONS

8.1. This agreement constitutes the sole and final agreement between the parties regarding the lease relationship.
8.2. In the event that either party fails to notify the other in writing of a change of address, notifications sent to the existing addresses shall be deemed valid.
8.3. This agreement has been drawn up in duplicate, with each party retaining one copy.


ARTICLE 9 – APPLICABLE LAW AND JURISDICTION
