SAMPLE ENFORCEMENT PETITION (ENFORCEMENT PROCEEDINGS BASED ON A JUDGMENT)

1. Heading: Write the name of the enforcement office

In enforcement proceedings based on a court judgment, the first line also specifies the enforcement office where the proceedings will be initiated. According to the law, enforcement of court judgments can be requested from any enforcement office.

2. Write down the creditor information

The creditor can be an individual or a company. Their full name/title, Turkish Republic Identity Number/Tax Identification Number, address, and bank account information (if any) should be provided.

3. Add a proxy if there is one

If the case is being handled through a lawyer, the lawyer's information is also included.

4. Fill in all debtor information completely

The debtor's name/title and address must be written correctly. This is because the enforcement order will be served to that address.

5. Write the matter clearly in writing as a court order for enforcement proceedings

6. Present the supporting document completely and accurately

This is the most critical part of enforcement based on a court judgment. The court name, case number, judgment date, and, if applicable, information regarding finality are written here. According to Article 32 of the Enforcement and Bankruptcy Law, when a judgment regarding a monetary debt is submitted to the enforcement office, an enforcement order is sent to the debtor.

7. List each of the awarded receivables individually

Whatever is ruled in the judgment must be clearly stated in the enforcement order. The type and quantity must be indicated in the enforcement order.

8. Clearly display the interest type and start date

In enforcement proceedings based on a court judgment, calculating interest is one of the areas where most mistakes are made. The type of interest and the starting date specified in the judgment must be followed in the enforcement proceedings. If the judgment specifies an amount of compensation, interest may also apply from the date of the judgment in some cases; therefore, the specific clause in the judgment should be taken as the basis.

9. Keep the explanations section short but concrete

In enforcement proceedings based on a court judgment, a lengthy description of the case is not necessary. The primary basis is the judgment itself. What needs to be done is to briefly state what the judgment decrees and why enforcement proceedings have been initiated based on it.

10. Add supporting documents

In enforcement proceedings based on a court judgment, the most fundamental document is the judgment itself. In practice, most files include a copy of the decision, the decision with the finality annotation (if applicable), a statement of accounts, and a power of attorney. If the enforcement is based on a document with the nature of a court judgment, that document is also included. Article 38 of the Enforcement and Bankruptcy Law explicitly acknowledges that certain documents are subject to the provisions for the enforcement of court judgments.

11. Clearly state the outcome of the request

In enforcement proceedings based on a court order, the request send an enforcement order and continue with compulsory enforcement if payment is not made. According to Article 32 of the Enforcement and Bankruptcy Law, the enforcement order states that the debt within 7 days ; if payment is not made within this period and a decision to suspend enforcement is not obtained, compulsory enforcement will be carried out. The debtor is also obliged to declare their assets within this period.
