Request for Prioritization of File Review

Due to the Interruption of the Treatment Process

Dear Prosecutor's Office,

My client is currently being held in custody at a correctional facility. Unable to have children, my client, with the support of his wife, began in vitro fertilization (IVF) treatment, but the process has been interrupted due to his detention. Timely intervention is essential to ensure the continuation of treatment, as interruptions could lead to irreversible health problems and negatively impact the family unit.

For these reasons, it is of vital importance that my client's case be given priority and concluded as soon as possible. Article 141, paragraph 3 of the Constitution stipulates that it is the duty of the judiciary to conclude cases as quickly as possible and with the least possible expense.

Article 6 of the European Convention on Human Rights guarantees the right to a fair trial and stipulates that proceedings must be completed within a reasonable time. According to Article 40 of the Court of Cassation Law No. 2797 and Article 141, paragraph 4 of the Code of Criminal Procedure, it is essential that investigation and prosecution processes be completed within a reasonable time.

My client's health is at risk of deteriorating due to the fact that our case is awaiting review in the Supreme Court archives. Therefore, in order to ensure that justice is served swiftly and with public conscience in mind, I respectfully request that our case be reviewed as a matter of priority.
