Remote Work and Digital Work Environment Agreement

REMOTE WORKING AND DIGITAL WORKING ENVIRONMENT AGREEMENT

PARTIES
between the parties: on one side, the company operating at …………………………… address, registered with the …………………………… Trade Registry under registration number ……………, and liable to the …………………………… Tax Office with tax number …………………………… EMPLOYEE,
on the other side, residing at …………………………… address, with Turkish Republic Identity Number: …………………………… ”),
under the following terms and conditions.


ARTICLE 1 – SUBJECT OF THE AGREEMENT

This agreement regulates the procedures and principles regarding the Employee's performance of their duties from home or another remote work environment using digital tools.


ARTICLE 2 – WORKING CONDITIONS

2.1. The employee undertakes to work ………… hours per week and to be online between ………… hours on ………… days.
2.2. The employee is obliged to use the communication tools specified by the employer (email, video conferencing platforms, project management software, etc.).
2.3. The employer is obliged to provide the employee with the necessary software licenses and hardware to perform their duties.


ARTICLE 3 – FEES AND PAYMENTS

3.1. The employee will receive a monthly gross ………… TL .
3.2. Payments will be deposited into the employee's bank account on ………… day of each month.
3.3. If the employee works overtime, they may request additional compensation in accordance with the provisions of the Labor Law No. 4857.


ARTICLE 4 – OCCUPATIONAL HEALTH AND SAFETY

4.1. The employee is responsible for preparing the remote work environment in a safe and ergonomic manner.
4.2. The employer is responsible for informing the employee about occupational health and safety during remote work.
4.3. The employee shall immediately report any work accident or occupational disease to the employer.


ARTICLE 5 – PRIVACY AND DATA SECURITY

5.1. The employee shall keep confidential all information and documents relating to the employer's business processes.
5.2. The employee shall use the computer, software, and email address assigned to them solely for business purposes.
5.3. The employer is obligated to protect employee data in compliance with the Turkish Personal Data Protection Law (KVKK) and GDPR.


ARTICLE 6 – DIGITAL WORK ENVIRONMENT RULES

6.1. Employees are required to attend digital meetings on time and report on work processes regularly.
6.2. Employees may not share information about the employer on social media, forums, or similar platforms that violates company policies.
6.3. The employer may monitor employee performance through digital systems when deemed necessary.


ARTICLE 7 – EQUIPMENT AND MATERIALS

7.1. Computers, telephones, software licenses, and other equipment provided by the employer must be returned upon termination of the employment contract.
7.2. Any damage to equipment caused by the employee's fault will be recovered from the employee.


ARTICLE 8 – DURATION AND TERMINATION

8.1. This contract will commence on ………… and is drawn up as an indefinite/………… term contract.
8.2. The parties may terminate the contract, provided they comply with the notice periods stipulated in the Labor Law.
8.3. If either party seriously breaches its obligations, the other party has the right to terminate the contract immediately for just cause.


ARTICLE 9 – MISCELLANEOUS PROVISIONS

9.1. This agreement constitutes the sole and final agreement between the parties.
9.2. Unless either party notifies the other party in writing of any change of address, notifications sent to the existing addresses shall be deemed valid.
9.3. The invalidity of any provision of this agreement shall not affect the other provisions.


ARTICLE 10 – APPLICABLE LAW AND JURISDICTION

to disputes arising from this agreement Turkish law shall apply
