Subject: Request for notification of my professional excuse.

EXPLANATIONS:

I will be unable to attend the hearing scheduled for …/…/… at … o'clock in the future, regarding case number …/… of your esteemed court, as I need to attend another hearing at the Bursa … Civil Court of First Instance, case number …/…, at 10:00 on the same day. Since both hearings are in different cities, simultaneous attendance within the specified times is not physically possible.

In order to diligently carry out my professional duties, I am giving equal importance to both case files. However, due to this conflict, my apology is deemed necessary.

Basis of Supreme Court Jurisprudence:
In the decision numbered 2020/6543 E., 2021/9876 K. of the 3rd Civil Chamber of the Supreme Court, it was emphasized that lawyers' requests for excuses in cases where they cannot fulfill their professional obligations should be considered with justifiable reasons. It is a matter of fairness that lawyers, who contribute to the effective and fair functioning of the judiciary, should be able to declare excuses in the face of force majeure.

CONCLUSION AND REQUEST:
For the reasons explained above,

1. I request that my professional excuse be accepted and the hearing be postponed to a date convenient for me
2. I request to be notified of the new hearing date
