EXPLANATIONS

1. My client's uncle (deceased's full name) passed away on …/…/… and left behind an estate consisting of numerous real estate properties and bank accounts. However, disagreements have arisen among the heirs regarding the management of the legal and financial transactions related to the estate, and it has become necessary to appoint a representative for the estate in order to manage the process effectively.
2. In a lawsuit filed by a third party concerning a property listed in the deceased's estate records (case number …/…), the estate needs to be granted party status. However, procedural issues are arising in the case because there is no representative authorized to act on behalf of the estate. Therefore, my client requests to be appointed as a representative for the estate in his capacity as a legal heir.
3. According to Article 640 of the Turkish Civil Code, it is possible to appoint a representative for the estate, and this appointment is essential for carrying out the necessary legal transactions on behalf of the estate. My client is an heir who meets all legal requirements and is capable of acting on behalf of the estate.
