Petition for Increasing Interim Alimony Payments

SUBJECT: My requests consist of increasing the monthly interim alimony payment from …-TL to …-TL by adding …-TL.

EXPLANATIONS:

  1. We divorced the defendant on …/…/… and the divorce decree of the … Family Court, case number …/…, decision number …/…, became final on …/…/…. We have a son, Ada Deniz, born on …/…/… from this marriage. Child support for our joint child has been determined since the date of the divorce decree.
  2. The defendant has repeatedly stated that the alimony amount, set at ...-TL after the divorce, is insufficient. Currently, this alimony is far from meeting our child's growing needs. The defendant is known as a successful architect with a large client portfolio and runs a high-income business. Given his improved financial situation, an increase in alimony is necessary to meet our child's needs. Furthermore, he has recently been avoiding contact with our child.
  3. The court-determined alimony of …-TL is insufficient to cover our child's education and healthcare expenses, as our child is … years old. This situation is causing me great difficulty in meeting the necessary expenses for educational materials, private tutoring, and healthcare services for my child. I am experiencing serious difficulties in meeting my child's basic needs.
  4. According to Article 196 of the Turkish Civil Code; “Upon the request of one spouse, the judge determines the monetary contribution each spouse will make for the upkeep of the family. The spouse's performance of household chores, childcare, and unpaid work in the other spouse's business are taken into account in determining the amount of contribution. These contributions may be requested for the past year and for future years.” As stated in the decision of the 3rd Civil Chamber of the Supreme Court of Appeals, numbered 2009/10019 and 2009/14058, dated September 17, 2009, the right to request an increase in alimony is reserved. In this context, our requests for an increase in the current alimony amount should be evaluated by your court.
  5. It is clear that the purchasing power of the alimony amounts awarded in previous years has significantly decreased due to changes in economic conditions and the effects of inflation. Considering the improved financial situation of the defendant and the current needs of our child, we believe that the alimony should be increased. This is of great importance for the protection of our child's rights and the fulfillment of their basic needs.
