Petition for Compensation Due to Cooperative Membership and Unjustified Objection

Subject: Cooperative Membership and Claim for Compensation Due to Unjustified Objection

Explanations:

Our client paid the necessary fees to participate in the construction projects of the ... Construction Cooperative, as per the membership agreement signed with the cooperative on .../.../... date. The fact that our client fulfilled all its obligations under the contract with the cooperative created the expectation that the cooperative would also fulfill the conditions it had committed to at the beginning of the projects. However, due to disruptions in the construction projects promised by the cooperative, material procurement issues, and significant delays in the construction process, our client decided to terminate its membership agreement with the cooperative on .../.../... date.

After the decision to withdraw was made, our client requested a refund of all payments made to the cooperative, but the cooperative made no payments and continuously delayed the process. As a result, our client initiated enforcement proceedings at the ... Enforcement Office to collect the receivables. However, the debtor cooperative unfairly objected to our client's requests, attempting to reduce the amount owed. These objections were primarily based on incorrectly determined interest rates and erroneous payment dates.

The objections in question lack legal basis, and our client's receivables must be definitively claimed without being affected by the debtor's unjustified objections. Our client's receivable and accrued interest have been calculated in accordance with legal regulations, and the debtor's unjustified objections are invalid. Furthermore, any request for a reduction in the amount of the receivable as a result of these objections is also legally invalid.

For these reasons, we have been forced to file this lawsuit to have all objections dismissed and to collect the receivables that our client is facing during this process, where they have been subjected to unjustified objections.

Evidence:

  1. Sample membership agreement with the cooperative
  2. Written documents regarding the request to withdraw from the cooperative,
  3. Payment receipts and bank statements,
  4. Documents relating to debt collection proceedings,
  5. Other documents relating to the cooperative's membership processes.

Legal Grounds: Turkish Enforcement and Bankruptcy Law, Turkish Code of Obligations and related legislation.

Conclusion and Request: For the reasons explained above:

  1. Due to the debtor's unjustified objections, all objections regarding the amount owed to our client are hereby dismissed
  2. Execution denial compensation at a rate of 20% of the amount owed,
  3. I request that the court order the defendant to pay the court costs and attorney's fees.
