EXPLANATIONS:
- My client entered into a written contract with the defendant on …/…/… as part of their commercial activities. Under this contract, products worth a total of … TL were delivered to the defendant, and all records relating to the delivery of goods were meticulously maintained. However, the defendant failed to pay their debts and abused their commercial relationship with my client.
- My client rightfully initiated enforcement proceedings through the ... Enforcement Directorate under file number .../... due to the defendant's failure to pay the debt. However, the defendant objected to these enforcement proceedings with completely unfounded and false statements, causing the process to be prolonged.
- The defendant's objections are solely aimed at delaying payment and causing my client financial harm. This is contrary to the principles of honesty and good faith in commercial relations. The damage suffered by my client is not limited to the inability to collect the debt, but also includes damage to his commercial reputation.
- My client's business ledgers, invoice records, and correspondence between the parties clearly demonstrate that the defendant owes the debt. In order to both collect my client's receivables and protect his reputation, your court must dismiss this unjustified objection by the defendant.
- Furthermore, the defendant's malicious conduct has caused my client significant harm. This objection, made solely to avoid payment, has resulted in my client suffering both loss of income and additional damages due to legal costs. Therefore, our claim for damages for malicious intent should be evaluated fairly.
