Notice Regarding Refund Arising from Consumer Law

EXPLANATIONS:

1. My client purchased a tablet from you on …/…/…, which was described as an undamaged tablet of model … . After receiving the electronic device via cargo, my client was unaware that the tablet had been opened and some parts replaced. This was discovered by a second buyer after the device was sold, and therefore the tablet was returned to my client. The damage to the device was noticed on …/…/…, and my client brought the device to you to inform you of the situation.
2. According to the Law on Consumer Protection, the consumer is obligated to notify the seller of any defect within two years from the date of delivery of the goods. Inthis case, the consumer has the right to withdraw from the contract, including a refund of the purchase price, to have the defective goods replaced with faultless goods of the same kind, to receive a price reduction proportional to the defect, or to request free repair. The seller is obligated to fulfill the consumer's chosen request. In addition to these optional rights, the consumer also has the right to claim compensation from the manufacturer/producer in cases where the defective goods cause death and/or injury and/or damage to other goods in use.
3. Our client purchased the vehicle with the expectation that it would be free of this defect, but the said fault compromises the tablet's originality and reduces its price. Therefore, our client has requested a replacement vehicle in accordance with the aforementioned legal regulation; however, you have not yet taken any steps to resolve the problem. Since we believe you will fulfill your legal responsibilities, we have deemed it appropriate to inform you of the situation one last time before resorting to legal action. We hereby warn you that within … days of the notification of this notice, you must terminate the contract, including a refund of the purchase price, replace the defective item with a faultless equivalent, or reduce the price proportionally to the defect. Otherwise, we will pursue legal action against you, and you will be responsible for court costs and attorney fees.
