Is using JetBrains IDEs without a license a crime?

However, most of these products are offered under paid licenses , and commercial use absolutely necessitates licensing . JetBrains licenses these IDEs, which are perceived as open-source or "free," in detail according to their usage. This is precisely where developers and companies face legal responsibility.

2. What is JetBrains' licensing structure like?

JetBrains' licensing policies are quite systematic:

  • Personal Use License: For personal projects and educational purposes.
  • Commercial License: Absolutely required for internal company use or paid project production.
  • Open-Source License: Suitable conditions only for those developing open-source projects.
  • Student License: Free for students for a limited period.
  • Free Trials: 30-day trial period, followed by licensing requirements.

Article 71:
Those who infringe on copyright shall be sentenced to imprisonment for a period of 1 to 5 years and a fine.

Turkish Penal Code (TCK)

Article 20/2: Legal entities are also liable for crimes committed in their name.

“Commercial products created with cracked software do not have ownership rights. The software itself becomes a criminal element.”

The 11th Civil Chamber of the Supreme Court of Appeals, Case No. 2020/5421 E. – 2021/2084 K.,
ruled: “A company using unlicensed software has been ordered to pay retroactive compensation and destroy its products.”
