Due to the strategic importance of energy markets, supply contracts are not merely a commercial agreement between the parties but are also subject to significant oversight in terms of public interest and market regulations. This article will examine how the responsibilities of the parties in energy supply contracts are defined, along with the theoretical legal framework and practical applications.


1. Legal Framework Regulating Energy Supply Contracts

Energy supply contracts are subject to both private law provisions and regulations stemming from public law. The main legal sources are as follows:

  1. Principles of Contract Law and Commercial Law – The Turkish Code of Obligations (TBK) and the Turkish Commercial Code (TTK) contain general provisions applicable to energy supply contracts.
