This article will examine the legal framework, process, and ethical dimensions of exhumation.

1. The Legal Basis for Exhumation

Article 81 of the Code of Criminal Procedure includes exhumation among the methods of gathering evidence. The purpose of this article is to ensure that evidence obtained during investigation and prosecution processes is collected in accordance with the law. Exhumation is used as an important means of gathering evidence, especially in cases related to serious charges such as murder, suicide, or other crimes causing death.

This process is not only a legal requirement but also of great importance from a human rights perspective. Exhumation must be carried out within the legal framework, respecting human dignity. Therefore, a court order is absolutely necessary before any exhumation can take place.

2. Process and Implementation Stages

Certain steps must be followed in order to carry out the exhumation process:

• Investigation Phase: The public prosecutor requests an exhumation when they deem it necessary to gather evidence related to the incident. This request usually depends on the circumstances of the case and the available evidence. For example, in a murder investigation, an exhumation may be necessary to determine the cause of death of the victim.
• Court Decision: Upon the prosecutor's request, the competent magistrate's court decides whether to order the exhumation. The court evaluates the necessity and legitimacy of the exhumation and makes a decision on the matter. The decision determines the conditions under which the exhumation will be carried out and how it will be performed.
• Procedure: After a court order is obtained, the exhumation is carried out under the supervision of forensic experts and other relevant specialists. During this process, the location of the exhumation is determined in advance, and security measures are taken at the scene.
• Reporting: After the exhumation is complete, a report is prepared detailing the findings. This report is submitted to the court and used as evidence throughout the proceedings.

3. Ethical Aspects and Considerations
