Decision to Suspend the Case in Criminal Proceedings

Criminal proceedings are conducted with the aim of evaluating evidence and reaching the material truth, while upholding the right to a fair trial for those suspected of committing a crime. However, in some cases, the trial process may become impossible due to temporary obstacles or legal reasons. This is where the "suspension of proceedings" decision comes into play. "In other cases specified in the laws, the court shall decide to suspend the proceedings."

  • If a fugitive or absent suspect is apprehended,

  • If the legal obstacle is removed, the court decides to "continue the case" and proceeds with the trial

  • 2020/4312 E., 2021/2643 K., the 1st Criminal Chamber of the Court of Cassation overturned the stay of proceedings decision, which was made without sufficient medical reports regarding the defendant's illness.

  • 2018/57 E., 2019/83 K., the Criminal General Assembly of the Court of Cassation upheld the decision to suspend proceedings due to the defendant being abroad and not being brought back for an extended period.
    These decisions clearly demonstrate that the reasons for suspension must be presented concretely and based on evidence.


Problems Encountered in Practice

In practice, some problems can be encountered in decisions to suspend proceedings:

  • Inadequate reporting: The lack of up-to-date and detailed reports is a problem, particularly in cases of suspension due to mental illness or health problems.

  • Statute of limitations: Incorrect calculation of the statute of limitations after a stay of proceedings has been granted may lead to the dismissal of the case.

  • Fugitive status of the defendant: If a fugitive defendant cannot be found, the case may remain pending for a very long time, which can have negative consequences for the victim and society.


The Right to a Fair Trial During a Case Suspension

While suspending the trial prevents its continuation, it is a measure that safeguards the defendant's right to defense and the right to a fair trial. Continuing the trial when the defendant is mentally incapacitated or unable to defend themselves a violation of the right to a fair trial .
