The widespread use of the internet and the integration of digital devices into our lives have led to an increase in digital crimes and the creation of a new area within criminal law. Digital crimes have different characteristics from traditional crimes, and how criminal law adapts to and regulates these new types of crimes has become one of the most important issues in contemporary law.

Defining Digital Crimes

Digital crimes are crimes committed through the use of digital technologies. These crimes can be committed directly in digital environments, or by using digital environments as a tool to commit crimes. In the Turkish Penal Code (TCK) and other relevant regulations, digital crimes are generally defined as "computer crimes" or "internet crimes," and these crimes include unauthorized use of personal data, internet fraud, identity theft, cyberattacks, and digital threats.

The Effects of Digital Crimes on Criminal Law

  1. Definition of Digital Crimes and Legal Regulations

    Digital crimes are offenses that require a new framework in criminal law, both in terms of substantive and moral aspects. Articles 243 and 244 of the Turkish Penal Code contain provisions regarding digital crimes such as "unauthorized access to information systems" and "damaging information systems." While these regulations provide an important starting point for how digital crimes should be evaluated in criminal law, they may be insufficient in the face of rapid changes in the digital world. In particular, new digital areas such as social media, cloud systems, and artificial intelligence open up a debate on how criminal law should provide oversight in these areas.

    The legal validity of digital evidence obtained after the commission of digital crimes is of paramount importance. Unlike traditional methods of evidence gathering, preserving, monitoring, and presenting evidence in court for crimes committed in a digital environment is a process requiring expertise. The legal validity of digital evidence generally requires protecting suspicious data against the risk of manipulation and ensuring the continuity of the chain of evidence.     Cybercrimes constitute a specific subset of crimes committed in the digital environment. These crimes include hacking, network attacks, data theft, virus infection, and cyber espionage. Criminal law treatment of these crimes generally requires specific regulations. For example, considering the scale and scope of cyberattacks, severe penalties may be imposed to combat such crimes. In Türkiye, the Cybercrime Department, established to combat cybercrimes, plays a significant role in the fight against digital crimes.

Legal Protection and Solutions Against Digital Crimes

  1. New Legal Regulations

    In today's world, where digital crimes are on the rise, the Turkish Penal Code needs to include more comprehensive regulations addressing these crimes. These regulations should not only include general provisions related to cybercrimes, but also specific provisions concerning data security, personal data protection, and types of crimes committed in the digital environment. Furthermore, mechanisms should be established to proactively identify new types of crimes in the digital world and to update legal regulations in a timely manner.

  2. Education and Awareness

    To prevent digital crimes and ensure the effective application of criminal law, it is necessary to increase the level of education and awareness regarding digital security in society. Public institutions and the private sector raising public awareness about measures to combat digital crimes can help prevent their increase.

  3. International Cooperation

    Digital crimes are crimes that can transcend international borders. Therefore, international cooperation is of great importance in combating digital crimes. Turkey can develop an effective strategy for the prevention and punishment of digital crimes by cooperating with the European Union and other international organizations.

Conclusion

Digital crimes are an area that challenges the traditional boundaries of criminal law and requires rapid legal adaptation. While the current regulations in the Turkish Penal Code provide a foundation against digital crimes, the need for further regulations and improvements in this area is clear. Effective combat against digital crimes requires not only criminal regulations but also solutions such as education, awareness, and international cooperation. In this process, ensuring digital security is of critical importance for the protection of individuals and society.
