CONSTRUCTION INSPECTION AGREEMENT

Parties

Article 1 – the building owner ……………………………………………. or ……………………………………………. acting on his behalf (hereinafter referred to as “Building Owner”) on one side, and ……………………………………………. residing at ……………………………………………. address (hereinafter referred to as “Building Inspection Organization”) on the other side, under the following terms and conditions.

Subject and Location of the Commitment

Article 2 – The subject of this contract is the supervision of the construction of a building with a total construction area of ​​…… m² and …… floors (excluding basement floors) located at ………………………….. address, ………………………….. district, ………………………….. in the ………………………….. province, registered in the land registry under plot …., block …., parcel …., ensuring that the construction is carried out in accordance with the projects, building permits and their annexes.

Duration of Service

Article 3 – The inspection service will commence on ../../…., the date of signing the contract, and will continue until the building occupancy permit is obtained.

• The estimated time for completion of construction is ……………………….. months/years.

• If construction does not commence within two years of obtaining the building permit , or if it commences but is not completed within … years , this contract shall automatically terminate.

Service Fee

Article 4 –

The determined service fee, including VAT, installments as specified in Article 5. The relevant authority will not permit construction to continue without payment of the fee.

In case of extension, an additional service fee of %... of the price will be charged for each additional 6 months.

Payment of Service Fee

Article 5 – The service fee shall be paid to the construction supervision organization in accordance with the progress payment reports prepared within the framework of the relevant regulation.

• When the roof, infill walls and utility infrastructure are completed: % ….

• When the building is ready for plastering, the remaining %….

The advance payment is deducted from the first progress payment. Additionally, interim progress payments can be prepared based on the assessment reports.

Duties and Responsibilities of the Building Inspection Organization

Article 6 – The duties of the organization are summarized as follows:

• Checking that projects comply with zoning plans, regulations, and standards

• To ensure that the soil investigation report complies with regulations and that the load-bearing system is designed according to the relevant regulations

• To confirm the conformity of materials and manufacturing processes to standards through laboratory tests

• To inspect the concrete pouring and prepare the necessary samples and reports

• Reporting constructions that violate the permit to the relevant authority

• Preparing a report stating that the building has been completed in accordance with the permit projects

• After obtaining the building occupancy permit, responsibility will be assumed for the load-bearing system for .... years, and for other parts for .... years.

Notification Address

Article 7 – The building inspection organization shall maintain a notification address in Turkey and shall notify the building owner in writing of any changes.

Technical Staff List

Article 8 – The list of architects, engineers, and other technical personnel who will be assigned to the inspection service is included in the annex, and any changes in assignments will be notified to the building owner and the relevant administration within …. days at the latest.

Termination of Service

Article 9 – When the building inspection organization notifies the relevant authority by report that the building is completed and ready for occupancy permit, the contract terminates upon receipt of the occupancy permit.

Dispute Resolution

Article 10 – The courts and enforcement offices of ………………………………….. shall have jurisdiction in resolving disputes arising from this agreement.

Miscellaneous Provisions

Article 11 – In matters not covered by this agreement, of Law No. 4708 on Building Inspection, the Zoning Law, and related legislation shall apply.
