Compulsory Insurance in Maritime Law

Maritime transport is inherently a risky sector. Unforeseen events such as storms, pirate attacks, cargo damage, environmental pollution, or maritime accidents can cause significant financial losses for shipowners, carriers, and cargo owners. Therefore, mandatory insurance practices come into play to minimize risks and safeguard the rights of all parties. The Turkish Commercial Code (TTK) aims to ensure both the security of trade and environmental protection by making certain types of insurance mandatory in maritime trade.


Legal Basis of Compulsory Insurance

Damages that may occur during maritime transport can affect not only shipowners but also third parties and the environment. Therefore, national and international regulations mandate that shipowners and carriers obtain certain types of insurance.

Article 1278 of the Turkish Commercial Code and related regulations form the basis of mandatory insurance. Furthermore, MARPOL, CLC (Civil Liability Convention) , and the Bunker Convention also require shipowners to obtain insurance to cover potential damages to third parties.


The Purpose of Compulsory Insurance

Compulsory insurances in maritime transport safeguard three main objectives:

  1. Passenger and Cargo Safety: In the event of damage to passengers or cargo on board, prompt and fair compensation will be provided.
  2. Third-Party Damages: Damages that may occur to ports, other vessels, or the environment are covered.
  3. Environmental Protection: The financial consequences of environmental disasters that may be caused by oil spills and other marine pollution are secured.

Types of Mandatory Insurance in Maritime Trade

a) Oil Pollution Liability Insurance (CLC Insurance)

Oil tankers and large fuel carriers the CLC 1992 Convention . This insurance covers both environmental pollution and compensation claims.

b) Bunker Fuel Insurance

the Bunker Convention 2001 , ships are required to have insurance to cover environmental damage that may result from fuel leaks.

c) Passenger Liability Insurance

According to the provisions of the Athens Convention , passenger ships are required to have insurance that provides compensation in the event of injury or death to passengers on board.

d) Environmental Pollution and Port Damage Insurance

Some ports require ships to present insurance documents against the risk of environmental pollution upon entry. These insurances also cover damage to port facilities.

e) Compulsory Liability Insurance (P&I)

Protection & Indemnity (P&I) insurance protects shipowners against potential liabilities to third parties. For large commercial vessels, membership in P&I clubs is often mandatory.


Responsibilities of the Parties

Shipowner (Shipowner):

  • They are obliged to obtain mandatory insurance in accordance with the Turkish Commercial Code and international conventions.
  • They are required to present their insurance documents at port entrances.
  • They are responsible for paying their insurance premiums regularly and renewing their policies.

Carrier:

  • The carrier must obtain liability insurance for the cargo and passengers being transported.
  • They are responsible for initiating compensation proceedings in the event of damage or loss.

Insurance Companies:

  • When damage occurs, they are obligated to pay compensation promptly and clearly state the limits of their liability.

Mandatory Insurance Documents and Audits

Ship owners insurance certificates to port authorities during international voyages. If missing insurance documents are found during port state controls, the vessel may be prevented from sailing and administrative penalties may be applied.


Disputes and Compensation Process

Disputes arising under compulsory insurance are generally insurance arbitration commissions or commercial courts. Insurance compensation provides a quick solution in cases such as environmental damage, ship accidents, or cargo loss.
