TO THE REPUBLIC PROSECUTOR'S OFFICE
COMPLAINANT: Name and Surname (Turkish Republic Identity Number: …) Address: …
ATTORNEY: Lawyer's Name and Surname Address: …
SUSPECT: Name and Surname Address: …
CRIME: Forgery of private documents, fraud.
DATE OF CRIME: …/…/…
EXPLANATIONS:
My client signed a car purchase and sale agreement with the suspect on [date]. Although the suspect stated in the agreement that the vehicle had no damage history, it was later discovered that the vehicle was heavily damaged.
The suspect concealed the vehicle's damage status in the contract and made false statements with the intention of misleading my client. By doing so, the suspect has committed both the crime of forgery of a private document and the crime of fraud.
My client wanted to return the vehicle after realizing that the suspect had defrauded him, but the suspect refused to take it back.
According to the established jurisprudence of the Supreme Court's criminal chambers, misleading and harming a party by making false statements in a contract constitutes the crime of fraud.
My client has suffered both material and moral damages due to the suspect's wrongful acts. Because of the suspect's fraud, my client was forced to purchase a damaged vehicle at a price exceeding its market value.
EVIDENCE:
- Automobile purchase and sale contract,
- Documents showing the vehicle's damage history,
- Vehicle inspection report,
- Witness statements and other legal loopholes.
LEGAL GROUNDS: Article 207 (forgery of private documents), Article 157 (fraud) of the Turkish Penal Code and other relevant legislation.
CONCLUSION AND REQUEST: For the reasons explained above, I respectfully request and demand that the necessary investigation be conducted against the suspect for the crimes of forgery of private documents and fraud, and that a public prosecution be initiated and the suspect punished accordingly.
