Defined by a depreciation of currency and an increase in the general price level, inflation means a decrease in the value of receivables for creditors and an increase in the debt burden for debtors . In Turkish law, the impact of inflation is particularly observed in compensation calculations, interest rates , and the updating of receivables .

In its decision numbered 1999/10294 , the Court of Cassation ruled that, in order to prevent the real value of the receivable from being lost due to inflation , the current value on the payment date should be taken into account.

Another Supreme Court ruling stated that extra interest should be calculated based on the annual inflation rate

7.1. Method of Updating Accounts Receivable

The updating of receivables takes into account the creditor's anticipated loss and the debtor's inability to pay . Therefore, creditors have the right to request an update of their receivables each year

The following are considered when updating accounts receivable:

  • CPI (Consumer Price Index) rate,

  • Interest rates in the market,

  • Economic conditions and the debtor's ability to pay.

7.2. Updating the Nominal Value of Receivables

The nominal value of receivables should be updated proportionally to the inflation rate . The calculation used for this process is generally based on the Consumer Price Index (CPI ). Example: If a receivable was determined as 100,000 TL one year ago, and the CPI rate for that year was 10%, the receivable would be updated to 110,000 TL.

In the face of inflation, some debtors may prefer to pay their creditors in gold or dollars . The legal basis for this method rests on the contract between the creditor and the debtor. However, paying compensation in Turkish Lira may be advantageous for the debtor under current conditions .
