Boat Depreciation Compensation Lawsuit
Boat Depreciation
While boats are moored in a marina, they may collide with another boat, or a fire on one boat may spread to other boats moored in the harbor. The resulting decrease in boat value encompasses lawsuits filed to recover compensation for damages to the boat.
The Importance of Boat Insurance
Boat insurance covers the loss of monetary value of a boat against many hazards such as fire, collision, weather conditions, grounding, or sinking. Boat depreciation includes many situations such as marine accidents, theft, fire, liability to third parties, piracy, natural disasters, and wreck removal. Boat insurance is not mandatory in our country.
Boat Depreciation Compensation Lawsuit
Boat depreciation compensation claims aim to recover the value lost by the owner against claims for moral damages from third parties. When determining boat depreciation, the boat's make, age, physical and technological characteristics, and the location where the accident occurred are all very important factors.
A lawsuit for compensation for the depreciation of a boat can be filed with the boat owner, who is the at-fault party, or with the boat's insurance company. Boat depreciation compensation cases are heard by the Civil Court of First Instance. The statute of limitations for filing a lawsuit to recover damages caused to your boat by third parties is two years. The compensation lawsuit must be filed within two years of the date of the accident. The boat owner can file lawsuits for both material and moral damages to compensate for the losses suffered as a result of the boat accident.
How to File a Lawsuit for Depreciation in Boat Value?
For a lawsuit concerning the depreciation of a boat's value, the party filing the lawsuit must be less at fault than the other party. The party at fault does not have the right to sue the boat owner or insurance company for compensation for the boat's depreciation in value.
The court determines the degree of fault, with the less culpable party having the right to file a lawsuit. If the other party is found 100% at fault in a boat depreciation claim, they are required to pay for all the damage to the boat. An application for boat depreciation compensation can also be made to the Insurance Arbitration Commission.
To apply for an Insurance Estimation Commission assessment, the insurance company must be contacted within 30 days, and no resolution must have been reached. Amounts up to 5,000 TL are final and there is no right to appeal. Filing a claim for material and moral damages, based on the amount of the boat's depreciation in value, is preferred by the boat owner to alleviate their losses.
