SUBJECT:
Request for the reopening of a case dismissed due to lack of evidence, free of charge, and for a hearing date to be set, in accordance with Article 150/1 of the Code of Civil Procedure.

EXPLANATIONS:

1. Your court's case file, bearing the aforementioned case number, was previously dismissed for various reasons. However, this does not mean the case has been terminated due to lack of evidence, and the need to reopen this file has arisen.
2. In the process that formed the basis of the decision to dismiss the case, the parties to the lawsuit submitted reasoned excuses, but the decision to dismiss the case was made without considering these excuses. The legality of this decision is questionable, and no action has been taken on the merits of the case.
3. According to Article 150 of the Turkish Code of Civil Procedure, it is possible to reopen cases that have been dismissed. In this context, a request is made for the case to continue and for the file to be processed and a new hearing date to be set.

CONCLUSION AND REQUEST:

For the reasons explained above;

1. In accordance with Article 150/1 of the Code of Civil Procedure, our case, which was dismissed due to lack of follow-up, shall be reopened without fee
