PUBLIC PROCUREMENT SERVICES PROCUREMENT CONTRACT

ARTICLE 1 – SUBJECT OF THE AGREEMENT
The subject of this contract is the provision of ………………………………… services by the Contractor as a result of the tender opened by the ………………………………. Administration, the performance of this service, and the determination of the rights and obligations of the parties.
ARTICLE 2 – SCOPE OF SERVICE
2.1. The Contractor shall fully perform the works and services specified in the tender technical specifications.
2.2. The service period is ………… years, with the contract start date being ………… and the end date being ………….
2.3. The equipment, vehicles, and personnel to be used during the performance of the service shall be provided by the Contractor.
ARTICLE 3 – CONTRACTOR'S OBLIGATIONS
3.1. To act in accordance with the provisions of Law No. 4734 on Public Procurement and Law No. 4735 on Public Procurement Contracts in the performance of the service.
3.2. To comply with the standards and quality criteria determined by the administration.
3.3. To ensure the continuity of the service and to prevent disruptions in the execution of the work.
3.4. To take occupational health and safety measures and to provide necessary training to its personnel.
3.5. To obtain the necessary insurance to cover any damages that may occur during the service.
ARTICLE 4 – OBLIGATIONS OF THE ADMINISTRATION
4.1. To provide the contractor with the necessary workplace, documents, and permits for the execution of the service.
4.2. To provide the necessary supervision and guidance to ensure the contractor can perform its work properly.
4.3. To make payments to the contractor within the timeframe and conditions specified in the contract.
ARTICLE 5 – PRICE AND PAYMENT TERMS
5.1. The service fee is …………… TL excluding VAT, and payments will be made in ………… periods.
5.2. The contractor will submit progress payment reports to the Administration regularly.
5.3. Payments are contingent upon the work being completed fully and in accordance with the specifications.
ARTICLE 6 – SECURITY

6.2. The guarantee shall be returned upon completion of the work and expiration of the warranty period.
ARTICLE 7 – PENALTY CLAUSE AND LIABILITY
7.1. If the contractor fails to perform the service on time or completely, a penalty of ………… TL per day will be applied.
7.2. The contractor is obliged to compensate for any damages arising from their fault.
ARTICLE 8 – INSPECTION AND ACCEPTANCE
8.1. The Administration's officials have the right to conduct all kinds of inspections during the performance of the service.
8.2. The work is accepted as completed after the acceptance procedures carried out by the Administration.
ARTICLE 9 – DURATION AND TERMINATION
9.1. This contract is valid for a period of ………… years.
9.2. In the event that the Contractor fails to fulfill its obligations, the Administration may terminate the contract without the need for written notice.
ARTICLE 10 – RESOLUTION OF DISPUTES
