THE CRIME OF FRAUD THROUGH A PROMISE OF MARRIAGE

" Fraud by promising marriage ," a crime that has become increasingly common today , is one of the consequences of the malicious use of the internet. Especially recently, individuals are being deceived through various online platforms with promises of marriage, suffering both financial and emotional harm.

For the crime of fraud to occur, the perpetrator must deceive someone through fraudulent conduct capable of misleading them, thereby causing harm to that person or another, and gaining benefit for themselves or another.

In such cases, the defendant promises to marry the victim, obtains an unfair advantage from them, and then disappears. Thus, cases where the defendant actually marries the victim but separates shortly afterward for various reasons are considered separately; in this case, the defendant's intent is examined—whether the defendant genuinely intended to marry, in other words, whether they had the motive of defrauding. If the defendant meets with the victim with the intention of marriage but then leaves due to disagreement, the elements of the crime may not be present, and an acquittal may be granted.

The crime of fraud through a promise of marriage, a type of aggravated fraud, can victimize both women and men. Therefore, certain elements are necessary for the crime of fraud through a promise of marriage to occur.
