This concerns our requests for the withdrawal of the lawsuit.
EXPLANATIONS:
- As a result of ongoing disagreements between the plaintiff client and the defendant, the marriage has become unbearable, and therefore, a divorce case based on the fundamental breakdown of the marriage was filed by us before your court on …/…/… with case number …/… .
- Since the filing of the lawsuit, an agreement has been reached between the parties regarding an amicable divorce as a result of negotiations. However, due to the date of their marriage, …/…/… , the legal conditions for the amicable divorce procedure have not yet been met.
- This situation, coupled with the defendant's notification that an amicable divorce case should be filed after one year of marriage, has necessitated requesting the withdrawal of the contested divorce case registered with your court under case number …/… pursuant to Article 123 of the Code of Civil Procedure
- Throughout this process, both parties have expressed their desire for the divorce to be finalized as quickly and amicably as possible. Our agreement that the process will be less challenging through an amicable divorce strengthens our request to withdraw the case.
CONCLUSION AND REQUEST:
For the reasons briefly presented and explained above, the Family Court of … of the contested divorce case registered under Article 123 of the Code of Civil Procedure, that the defendant be asked about the matter of withdrawal, that no attorney's fees be awarded in favor of the defendant since an agreement has been reached, and that the necessary procedures be carried out promptly in accordance with our requests.
