What is UYAP (National Judicial Network Information System) and how does it work?

UYAP, the National Judicial Network Information System, is a central information platform that digitally connects judicial units, civil courts, enforcement offices, prosecutor's offices, and the central organization of the Ministry of Justice in Turkey. It accelerates judicial processes, increases transparency, and serves the goal of a paperless justice system. Implemented gradually since the early 2000s, this system is now the "digital backbone" of the Turkish legal system.

The Main Purpose of UYAP

Since its implementation, UYAP's primary goal has been to standardize the flow of information between judicial units, increase transparency in case processes, reduce archiving costs, and most importantly, support the principle of "swift justice" through technical means. The transition from a traditional judicial system where inter-court correspondence took weeks, physical files were at risk of being lost, and notification processes were lengthy, to a digital environment where data is transmitted in seconds, is revolutionary in terms of strengthening the principles of the rule of law.

How does UYAP work?

UYAP operates with a highly secure, cloud-based architecture built on a central server structure, ensuring uninterrupted data transmission between central and regional organizations. We can examine the system's operating logic through the following basic mechanisms:

1. Central Database and Integrated Structure

UYAP connects courthouses, regional courts of appeal, and the Supreme Court across Türkiye to a single database. A case initiated in an enforcement office is recorded in the central system within seconds. This centralized structure makes it possible to track the location of a file, its current stage, decisions made, and actions taken in real time.

2. E-Signature and Secure Access

The system's security Qualified Electronic Signatures (E-Signatures) . Judges, prosecutors, lawyers, and enforcement officers record their transactions in the system by approving them with e-signatures. An e-signature means that the document is original, has not been altered, and has been signed by an authorized person. This guarantees the legal validity and irrefutability of every decision produced in UYAP.

3. Inter-institutional Integration

UYAP is not just a system that operates within the courthouse. The system shares real-time data with many public institutions. For example;

  • MERNIS: To obtain the debtor's address and identity information.

  • TAKBİS: For querying land registry information and placing liens on real estate.

  • BANKS: To manage deposit seizure (electronic seizure – E-Seizure) processes in real time,

  • EGM/TÜVTÜRK: Integrated with UYAP to query vehicle registration records and process seizures. Thanks to these integrations, the enforcement officer can access the debtor's assets or apply seizure procedures with a single click, without any physical correspondence.

The Role of UYAP in Enforcement and Bankruptcy Law

Enforcement processes are one of the areas where UYAP is most actively used. The entire process, from initiating enforcement proceedings to the liquidation of the debtor's assets, is managed through UYAP

  • Electronic Enforcement Request: The creditor's representative submits the enforcement request to the enforcement office via the UYAP Lawyer Portal. Fees are calculated and paid through the system.

  • Service of Payment Order: The enforcement office automatically sends the payment order, created via UYAP, for service through UYAP-PTT integration.

  • E-Attachment Processes: The enforcement officer sends the attachment request to be placed on the debtor's bank accounts to the banks' UYAP interface via the system. The banks respond to this request instantly through the system and transmit the result to the enforcement office, again via UYAP.

  • File Management: All documents, petitions, and decisions within the file are prepared using the "UYAP Document Editor" and uploaded to the system with an e-signature. The physical file now serves only as backup evidence; the original file lives on digitally.

Citizen and Lawyer Portals

UYAP is not just a system used by judicial personnel; it is also a platform where parties are involved in the processes

  • Citizen Portal: Individuals with a pending lawsuit or those facing enforcement proceedings can log into the system using their e-Government password to instantly view their case files, enforcement proceedings, seizure status, and any court decisions. This represents the digital equivalent of the "right to be informed of legal proceedings."

  • Lawyer Portal: Lawyers can submit petitions to their files, initiate new proceedings, obtain copies from files, and participate in hearings electronically (via SEGBİS) through UYAP. For enforcement lawyers in particular, this portal acts like a control panel, enabling them to manage hundreds of files simultaneously.

Advantages Provided by UYAP

The advantages offered by UYAP are not limited to speed alone:

  1. Transparency: Every action taken on the file is recorded in the system. The log records clearly show who performed the action and at what time.

  2. Cost Savings: Reduced paper usage, lower postage costs, and the elimination of archiving requirements result in significant savings in public resources.

  3. Processing Speed: Processes that used to take days – “correspondence, notification, wait for a response” – have now been reduced to seconds thanks to integrations.

  4. Reduced Error Margin: Automatic fee calculations within the system, and system alerts regarding notification deadlines, have significantly reduced the margin of human error.

Future Vision and Artificial Intelligence

The UYAP system has a continuously updated structure. In the future, the goal is to have drafts of court decisions prepared by AI-powered programs, to analyze the debtor's payment potential in enforcement proceedings using data, and to integrate "Alternative Dispute Resolution Methods" into the system for resolving disputes.

UYAP is not just a technology project, but a project for the modernization of the judicial system. In an area like Enforcement and Bankruptcy Law, where procedure and deadlines are vital, utilizing the capabilities offered by UYAP has become a necessity.
