Turkish Penal Code Article 252: What is the Crime of Bribery? Elements, Penalties, and Supreme Court Decisions

The crime of bribery is regulated in Article 252 of the Turkish Penal Code and arises when public officials agree to receive or promise to receive a benefit in violation of the requirements of their duties . Bribery is considered a threat to public order and is subject to severe criminal penalties. Below, a detailed examination will be conducted in light of the elements of the crime of bribery, its penalties, and Supreme Court decisions. 1. Elements of the Crime of Bribery According to Article 252 of the Turkish Penal Code, the elements of the crime of bribery are as follows:  The perpetrator must be a public official: The perpetrator of the crime of bribery must be a public official . It is not possible for individuals who are not public officials to accept bribes. The party offering the bribe can be both a citizen and a legal entity.  Obtaining a benefit related to duty: The crime of bribery involves a public official receiving or promising to receive a benefit in exchange for performing or not performing an action related to their duty . The nature of the benefit can be material or moral.  Existence of an Agreement: The actual receipt of the benefit is not necessary for the crime of bribery to be completed. An agreement between the parties to provide a benefit is sufficient. 2. Criminal Sanctions for Bribery According to the Turkish Penal Code, both the public official who commits the crime of bribery and the person who gives the bribe are punished with imprisonment from 4 to 12 years. However, there may be aggravating or mitigating circumstances in some cases. For example, if the effects of the crime affect a large number of people or are directed towards an important area such as public security, the penalties may be increased. 3. Examination of the Crime of Bribery in Light of Supreme Court Decisions The Supreme Court has developed important precedents regarding how the crime of bribery should be evaluated in practice . Below, the crime of bribery is examined in detail with Supreme Court decisions . Supreme Court 5th Criminal Chamber Decision (E.2019/2817 K.2020/1347) Case: A public official was tried on the allegation of receiving bribes from citizens. The crime is based on the act of an official receiving a benefit by promising to expedite and facilitate the affairs of citizens. The Supreme Court's Assessment: The Supreme Court ruled that an agreement on benefit between the parties is sufficient, and whether the bribe was actually delivered does not affect the formation of the crime. This decision emphasizes that the crime of bribery can only be established upon an agreement to provide a benefit.

































Conclusion: It was stated that the bribe itself was not necessary for the crime to be completed, and that merely making an agreement was sufficient. The public official's sentence was determined as 6 years imprisonment. Supreme Court Criminal General Assembly Decision (E.2015/371 K.2016/37) Case: A mayor was accused of accepting a bribe from a contractor in exchange for granting a building permit . It was alleged that the contractor would suffer significant losses if the building permit was not granted . Supreme Court's Assessment: The Supreme Court determined that the mayor abused his position to gain personal benefit and accepted the bribe by threatening not to fulfill his duties . The Supreme Court, stating that public officials have an obligation to act honestly and impartially in the process of granting building permits , emphasized that the violation of this obligation greatly harms public trust. Conclusion: The crime of bribery was found proven, and the defendant was sentenced to 8 years imprisonment. In this decision, the Supreme Court underlined how serious a crime it is for public officials to abuse their authority to gain personal benefit . Supreme Court 7th Criminal Chamber Decision (E.2018/1923 K.2019/2874) Case: A public official working in the healthcare sector was tried for accepting bribes from companies in exchange for a promise of benefit in the procurement of medical supplies. The companies offered the public official certain percentages of money to facilitate the sale of hospital supplies . Supreme Court's Assessment: The Supreme Court stated that the public official receiving a benefit in return for performing their duties correctly is one of the fundamental elements of the crime of bribery. In this case, it was ruled that the public official provided an advantage to the company by expediting the procurement of supplies and received a benefit in return. Conclusion: The public official was found guilty of bribery and sentenced to 7 years of imprisonment . Furthermore, it was emphasized that the penalty should be increased due to the crime being committed in a field closely related to public health, such as the medical sector . Supreme Court Criminal General Assembly Decision (E.2021/392 K.2021/578) Case: A public official received a bribe in exchange for not issuing a fine to a citizen, and this case was brought to court. The public official received a benefit in exchange for not issuing a traffic fine . Supreme Court's Assessment: The Supreme Court stated that receiving a benefit in exchange for not performing one's duty clearly constitutes the crime of bribery. The public official's abuse of power by failing to take punitive action was accepted as a situation constituting this crime


































Result: The defendant was sentenced to 5 years in prison. The Supreme Court emphasized that public officials must act honestly and impartially towards citizens, otherwise the crime of bribery will be considered committed. 4. Effective Repentance and Sentence Reduction in Bribery Crimes Another issue that stands out in Supreme Court decisions is the application of effective repentance. Under Article 254 of Article 39 of the Turkish Penal Code, if a person involved in a bribery crime shows effective repentance by reporting the situation to the authorities after committing the crime, they may be exempted from or have their sentence reduced.  Supreme Court Criminal General Assembly Decision (E.2017/298 K.2018/379): The sentence of the defendant who showed effective repentance and disclosed the crime was reduced, and they were sentenced to 3 years in prison. This decision shows that those who show remorse in bribery crimes can contribute to justice and obtain a reduction in their sentences . Conclusion Bribery is a serious crime that undermines public trust, resulting from public officials abusing their authority to gain personal benefit. Supreme Court rulings have established significant precedents regarding the crime of bribery and clearly defined its various elements. The requirement for public officials to be honest and impartial in the performance of their duties forms the basis of this crime.
