Transportation Insurance Claim

Businesses engaged in passenger transportation are required to insure their passengers. This insurance is known as Compulsory Road Transport Liability Insurance.

The Compulsory Road Transport Liability Insurance, implemented under the Road Transport Law No. 4925, provides coverage, up to the amount specified in the policy, for "material" losses incurred by the vehicle due to death or injury to a passenger or damage to property resulting from an accident occurring during the journey from the departure point to the destination point, including breaks and stops.

Who is required to purchase mandatory road transport liability insurance?

Article 5 of Law No. 4925 defines natural or legal persons who have obtained an authorization certificate and undertake transportation in their own name and on their own behalf for a fee. In other words, companies such as those engaged in intercity passenger transportation are obliged to insure their passengers, guaranteeing their material and moral well-being.

Coverage included in the insurance policy

  • Death benefit: If the accident causes the passenger's death within two years of the accident date, this covers the compensation for loss of support suffered by those deprived of the deceased's support.
  • Disability coverage: In the event that an accident causes a passenger to suffer a temporary or permanent disability immediately or within two years of the accident date, this coverage will cover the compensation for the disability determined after the completion of medical treatment and the final assessment of the disability.
  • Medical expenses coverage: This covers the costs of first aid, examination, check-ups, or outpatient or inpatient treatment in hospitals or other facilities, as well as other expenses required for treatment, for passengers injured in an accident.

Insurance start and end dates

Unless otherwise agreed, insurance coverage begins and ends at 12:00 noon Turkish time on the dates specified in the policy.

Period for applying for compensation for damages

The event giving rise to the claim must be reported to the insurer within 30 business days from the date the insured or beneficiary learns of it; if the event occurred abroad, the report must be made within 60 business days.
