Vehicles involved in accidents on roads and areas within road access:
- Fatal or injurious
- Causing material damage or experiencing similar consequences
Ultimately, compulsory motor vehicle insurance , also known as liability insurance , covers damages within the limits stipulated by law.
According to the laws of our country, every vehicle that can be on the road is required to have traffic insurance under its liability insurance scheme. Otherwise, vehicles without mandatory financial traffic insurance will not be allowed on the road in accordance with the Highway Traffic Law .
There are certain criteria that must be met for insurance coverage of damages resulting from traffic accidents under compulsory motor vehicle insurance. These criteria are as follows:
- A traffic accident must occur on a road or on a location considered as a road, as specified in Articles 1 and 2 of the Highway Traffic Law. Accidents occurring outside of these areas will not be covered by Compulsory Motor Vehicle Insurance.
- The traffic accident must result in death, injury, or property damage.
- There must be a causal link between the damage caused and the unlawful act.
Those who are required to obtain "Compulsory Motor Vehicle Insurance" are the operators of a vehicle. The purpose of this legal requirement is to cover the damages caused by businesses and operators with commercial purposes. On the other hand, in the event of a loss of life, Compulsory Motor Vehicle Insurance will provide financial compensation (loss of support, etc.) to the surviving relatives.
The scope of mandatory motor vehicle insurance is as follows:
- ZMSS only covers material damages. Material damages include claims by heirs following a person's death, compensation for loss of rights due to injury, and damage to property.
Matters not covered by mandatory motor vehicle insurance:
- Claims that the operator may bring against persons for whose actions he is held responsible under this Law,
- Claims that the business owner, his spouse, ascendants and descendants, those related to him through adoption, and his siblings with whom he lives may make due to damages to their property,
- Claims relating to damages for which the operator is not held liable under this Law,
- Claims arising from accidents in motor vehicle races or race trials held under the compulsory financial liability insurance coverage pursuant to the third paragraph of Article 105 of this Law,
- Damage to goods transported in a motor vehicle,
- Claims for moral damages.
