SAMPLE PETITION FOR ANNULMENT OF MARRIAGE DUE TO NULLITY

SUBJECT : Request for a declaration of nullity of marriage.
EXPLANATIONS:
1- My client and the defendant were married on June 12, 2023. They have no children.
2- My client learned that the defendant, Yusuf Güngör, was in the process of divorce after seeing a message on his phone. The message was from Filiz Güngör, with whom he was in the process of divorcing, and it was related to the divorce proceedings. After seeing the message, my client spoke with the defendant and learned that his current marriage had not yet ended.
3- As is known, for parties to marry, there must not be an existing marriage. If one of the parties is in an existing marriage, this constitutes an impediment to a second marriage; if a second marriage takes place, this indicates that the marriage is absolutely void.
4- Indeed, Article 145 of the Turkish Civil Code stipulates that "one of the spouses being married at the time of the marriage" is a ground for the annulment of marriage. For all these reasons, it has become necessary to apply to your court to determine that the marriage between the defendants is void.
EVIDENCE: 1- Family Identity Card, 2- Marriage Certificate, 3- Message received on the defendant's phone indicating their current marriage, 4- Population Registry Records.
LEGAL GROUNDS: Article 145 of the Turkish Civil Code No. 4721
CONCLUSION AND REQUEST: For the reasons stated above and other reasons to be investigated ex officio, I respectfully request and demand that our rightful claim be accepted, that the marriage between the defendants be declared invalid, and that the court costs and attorney's fees be borne by the opposing party. 16/09/2024
