In this article, we will examine how the crime of providing places and venues for gambling is regulated in the Turkish Penal Code (TCK) and the penalties related to this crime.
GAMBLING CRIMES IN THE TURKISH PENAL CODE
The Turkish Penal Code (TCK) contains various articles regulating gambling offenses. In particular, the crime of providing a place or venue for gambling is explicitly defined in Article 228 of the TCK.
ARTICLE 228 OF THE TURKISH PENAL CODE: PROVIDING A PLACE AND VENUE FOR GAMBLING
Article 228 of the Turkish Penal Code defines providing a place or venue for gambling as a crime and regulates the penalties for this crime. The full text of the article is as follows:
Turkish Penal Code Article 228:
- "A person who provides a place and facilities for gambling shall be punished with imprisonment from one to three years and a judicial fine from one thousand to two thousand days.".
- If a place and facilities are provided for gambling within the scope of organized crime activities, the penalty shall be increased by half.
- Anyone who provides a place or facilities for children to gamble shall also be punished with imprisonment from eight to twelve years
According to this article, providing a place or venue for gambling is a crime that can be committed both individually and as an organized group. Furthermore, providing a place or means for children to gamble is punishable by even harsher penalties.
ELEMENTS OF THE CRIME
For the crime of providing a place or venue for gambling to occur, certain elements must come together:
- GAMBLING: The fundamental element of the crime is gambling. Gambling can generally be defined as games based on chance or skill, with the possibility of winning or losing.
- PROVIDING A PLACE AND VENUE FOR GAMBLING: Another element of the crime is providing a place or venue for gambling. This may mean providing a physical location for gambling or offering other facilities that facilitate gambling.
- INTENT: For the crime to be committed, the perpetrator must have intent, meaning they must consciously and willingly want to commit the crime. The perpetrator must act knowingly and willingly by providing a place and venue for gambling.
CRIMINAL SANCTIONS
The penal sanctions specified in Article 228 of the Turkish Penal Code are designed to deter those who commit crimes. The penalty prescribed for the basic form of the crime is imprisonment from one to three years and a judicial fine from one thousand to two thousand days. However, the penalties are increased if the crime is committed in an organized manner or if a place or venue is provided for children to gamble.
ORGANIZED CRIME
The crime of providing a place or venue for gambling is punishable by half if committed in an organized manner. Organized crime refers to situations where multiple individuals come together to commit the crime in an organized way. Because such crimes pose a greater threat to social order and security, they are met with harsher penalties.
PROTECTION OF CHILDREN
Providing places and venues for children to gamble is punishable by harsher penalties in order to protect children, who are one of the most vulnerable segments of society. Article 228 of the Turkish Penal Code stipulates a prison sentence of eight to twelve years to prevent children from participating in such harmful activities.
APPLICATION AND JUDICIAL DECISIONS
The Turkish judicial system has issued various rulings regarding the crime of providing a place or venue for gambling. These rulings examine how the elements of the crime are assessed, the perpetrator's intent, and whether the crime was committed in an organized manner. The Supreme Court rulings serve as an important guide in the application of this law and the determination of the punishment.
INTERNATIONAL DIMENSION AND COMPARATIVE LAW
The crime of providing a place or venue for gambling is subject to similar regulations not only in Türkiye but in many countries. For example, in the United States, gambling activities are regulated on a state-by-state basis, with some states completely prohibiting it and others allowing it under strict supervision. In Europe, regulations vary from country to country. In England, gambling is legalized under specific rules and licenses. This comparative legal perspective can provide insight into how Türkiye's gambling regulations can be brought into line with international norms.
Technological Approaches in the Fight Against Gambling
With the advancement of technology, crimes related to providing premises and venues for gambling have taken on new dimensions. Online gambling activities, in particular, have made the control and punishment processes more complex. In Türkiye, online gambling and the provision of premises for these activities are also being regulated through legal frameworks. Technological solutions are being used to monitor internet service providers, shut down virtual casinos, and identify individuals participating in such activities.
SOCIOLOGICAL AND PSYCHOLOGICAL EFFECTS OF GAMBLING CRIMES
Gambling crimes should be considered not only in their legal aspects but also in their sociological and psychological impacts. Gambling addiction is a serious problem that negatively affects the lives of individuals and their families. Besides financial losses, gambling addiction can lead to increased domestic violence, divorce, and crime rates. Therefore, in combating gambling crimes, it is important to involve social services and psychological support mechanisms alongside legal regulations.
PREVENTION AND AWARENESS RAISING
Effectively combating gambling crimes requires preventive measures and raising public awareness. Educational campaigns, awareness campaigns about the harms of gambling, and the establishment of addiction counseling centers are some of the steps that can be taken in this context. Furthermore, informative lessons about the dangers of gambling can be included in school curricula to keep children and young people away from gambling activities.
UPDATING LEGAL REGULATIONS
Existing legal regulations concerning the crime of providing premises and venues for gambling need to be updated to adapt to the changing dynamics of technology and society. The rise of online gambling activities, in particular, necessitates a review and updating of regulations in this area. Continuously updating legislation and maintaining flexibility to accommodate new types of crimes will enable more effective combat against gambling offenses.
CONCLUSION
The crime of providing a place or venue for gambling is explicitly regulated in Article 228 of the Turkish Penal Code, which prescribes various criminal sanctions. This crime can be considered both individual and organized, and harsher penalties may be applied to protect children. In Türkiye, the fight against gambling crimes is carried out rigorously to maintain public order and prevent harm to individuals.
Legal regulations concerning the crime of providing premises and venues for gambling play a significant role in preventing such activities and punishing perpetrators. These regulations are critical for protecting the peace and security of society and are implemented based on the principle of the rule of law. In addition to existing regulations, updating them to adapt to the changing dynamics of technology and society is also of great importance. In combating gambling crimes, raising public awareness and implementing preventive measures, alongside legal regulations, will yield effective results.
