Request for separation (separation) of the case between the plaintiffs.

EXPLANATIONS:

1- In the compensation lawsuit filed due to a traffic accident currently being heard in your court, two siblings, my clients, are plaintiffs. According to the disability report obtained within the scope of the file, an examination is foreseen for one of the plaintiffs, ..., 18 months after the accident. For the other sibling, ..., the assessment determined a disability rate of 16.2%.

2- Subsequently, the actuarial expert's report stated that the plaintiff's material damages amounted to ... TL, and compensation for these damages is requested. However, since there is no final disability assessment yet for plaintiff ..., in order to prevent further hardship, the case of plaintiff ... should be separated and pursued as a separate lawsuit under a new case number. This is essential for speeding up the proceedings and preventing both plaintiffs from suffering any loss of rights.

3- If our request to separate the files is accepted, it will be possible to conduct the trial more effectively and ensure that justice is served swiftly.
