This article will examine in detail the legal meaning, types, procedures and methods, validity requirements, objection and annulment processes, and relevant laws concerning notifications.

Definition and Legal Significance of Service of process

This notification is necessary for the individual to exercise their legal rights and fulfill their obligations. In Turkey, notification procedures are regulated by the Notification Law and the Regulation on the Implementation of the Notification Law . This law and regulation specify in detail how notifications should be made, to whom they should be made, and within what timeframes they must be made.

Notification Law

The Notification Law, which came into force in 1959, regulates the procedures and principles of notification processes. The purpose of the law is to determine the procedures and principles of notification in order to ensure that legal proceedings are carried out in an orderly and secure manner. Notification Law Article 1

Article 1 – The purpose of this Law is to ensure that notifications are made to natural and legal persons in accordance with the form and conditions specified by laws and regulations.

Text of Article 12 of the Notification Law

Article 12 –

  1. (Amended first paragraph: 6/6/1985 – Article 4 of Law No. 3220) Postal distribution offices may be established in locations deemed appropriate by the Ministry of Justice, either at PTT offices or, as deemed appropriate by the highest local administrative authority, outside the scope of the judicial administration organization, for the delivery of notifications sent by PTT central directorates. These offices receive notifications sent by courts, enforcement offices, and other judicial authorities and deliver them to the relevant parties through their distributors for delivery to their addresses.
  2. (Additional paragraph: 11/1/2011-6099/4 art.) Notifications may be made electronically. The procedures and principles regarding how electronic notifications will be made, the creation of electronic addresses to which notifications will be sent, and their use shall be determined by regulation.
  3. Notification can also be made through authorized Turkish consulates in foreign countries.

Notification Law Article 17:

Article 17 – If the person to be served with the notice, or any person authorized to receive it on their behalf, is not available, the notice shall be served to the headman or a member of the council of elders of that place, or to a police chief or officer, against a signature. The serving officer shall have the person to whom the notice is delivered sign it and shall write the date of delivery and the name of the recipient on the notification receipt.

Types of Notifications

I. Public Institutions and Organizations: All public institutions and organizations are required to use the electronic notification system.

II. Legal Entities: Joint-stock companies, limited liability companies, and other legal entities are required to obtain and use an electronic notification address.

III. Self-Employed Professionals: Certain professional groups, such as lawyers, notaries, and financial advisors, are required to obtain an electronic notification address and receive notifications through that address.

IV. Natural Persons: Although electronic notification is not mandatory for natural persons, they can use this system by obtaining an electronic notification address.

Procedures and Methods of Electronic Notification

Proper electronic notification is crucial for the validity of legal processes. The basic steps and methods to be followed in the electronic notification process are as follows:

I. Obtaining an Electronic Notification Address

An electronic notification address is a digital address required for individuals or institutions to receive secure electronic notifications. This address is provided by PTT (Turkish Post) using a Turkish Republic Identity Number (TCKN) or Tax Identification Number (VKN). Applications for an electronic notification address are made through the relevant institutions.

II. Secure Electronic Signature Usage

For electronic notifications to be valid, they must be signed with a secure electronic signature. A secure electronic signature is a type of signature defined within the framework of the electronic signature law and produced in accordance with specific security standards. This signature guarantees who sent the notification and that its content has not been altered.

III. Creating and Sending Electronic Notifications

Electronic notifications are sent to the recipient's electronic notification address after being signed with a secure electronic signature. This process is carried out through electronic notification systems, and the moment the notification is sent is recorded in the electronic notification system.
