Negligent Injury Due to Traffic Accident

Negligent injury can be summarized as causing harm to the victim's body due to a lack of necessary care and attention, even if the intention was not to cause harm. It occurs when traffic rules, which everyone must follow, are not followed, thereby jeopardizing traffic safety.

In its simplest form, the crime carries a sentence of 3 months to 1 year imprisonment or a fine. However, factors such as the severity and permanence of the harm suffered by the victim, and its impact on their future life, may lead to an increase in the sentence. For example, this includes cases where the victim suffers a permanent scar on their face, or a pregnant woman experiences premature birth or miscarriage. Furthermore, if there is conscious negligence involved, meaning the defendant foresaw the resulting consequences but continued their actions, the sentence is also increased.

The victim has the right to file a lawsuit for material and moral damages.
