MARRIAGE BETWEEN A TURKISH CITIZEN AND A MONTENEGRO CITIZEN

The marriage process between a Turkish citizen and a Montenegrin citizen is conducted in accordance with the legal regulations of both countries. This process requires both citizens to submit specific documents and follow legal procedures. Here are the basic stages of the marriage process between a Turkish citizen and a Montenegrin citizen:

1. Required Documents

Both parties must submit various documents in order to apply for marriage. These documents generally include the following:

  • Identification Documents: Valid identification documents (passport or ID card) for both parties.
  • Birth Certificate: An official document containing the birth information of both parties.
  • Marital Status Certificate: Turkish citizens must prove their marital status and the absence of any impediments to marriage with a "marriage eligibility certificate" obtained from Turkey. Montenegrin citizens must also submit a marital status certificate.
  • Criminal Record Checks: Both parties may be required to submit their criminal record checks.
  • Medical Report: Sometimes couples may be asked to provide a medical report regarding their health status, but this is not always mandatory.
  • Residence Certificate: Montenegrin citizens are required to provide proof of residence in Montenegro, while Turkish citizens may be required to provide proof of residence in Turkey.

Some of these documents must be translated into Montenegrin and submitted with notarization. The documents must be translated by a sworn translator and notarized before being submitted to the Montenegrin authorities.

2. Marriage Application

Marriage applications must be submitted by the couple to the local marriage registry office in Montenegro. After completing the necessary documents during the application process, a wedding date will be set. Turkish citizens applying for marriage must provide documents demonstrating that they are not subject to any impediments to marriage under Montenegrin law and have the right to marry.

3. Wedding Ceremony

A wedding ceremony in Montenegro is a formal marriage ceremony conducted in the presence of a marriage officer. The ceremony usually takes place at the marriage registry office, but it can also be held at a different location if the couple prefers. The presence of two witnesses is mandatory during the ceremony.

According to Montenegrin law, a marriage is only valid after it has been officially registered. After the ceremony, the couple receives a marriage certificate, and the marriage is recorded in the civil registry.

4. Residence Permit in Montenegro for Foreign Spouse

A Turkish citizen can apply for a residence permit in Montenegro after marrying a Montenegrin citizen. Marriage helps the foreign spouse gain the right to legally reside in Montenegro. The application for a residence permit is submitted to the relevant authorities in Montenegro, along with the marriage certificate and other required documents.

A residence permit is granted temporarily after marriage, typically lasting between one and three years. However, it can be extended as long as the marriage continues, and an application for permanent residency can be made after a certain period.

5. Registration of Marriage in Türkiye

A Turkish citizen who marries in Montenegro must also have the marriage registered in Türkiye. The Montenegrin marriage certificate must be submitted to the relevant Turkish consulates or civil registry offices in Türkiye to register the marriage in Türkiye. This process ensures that the marriage is officially recognized in Türkiye.

6. Property Regimes and Inheritance Rights

The property regime and inheritance rights between a Turkish citizen and a Montenegrin citizen after marriage are governed by the legal regulations of both countries. In Montenegro, assets acquired during marriage are considered joint property, but couples can choose a separate property regime or another property regime before marriage. Similarly, inheritance rights are determined according to Montenegrin law.

Since Türkiye and Montenegro may have different property regimes and inheritance regulations, it is recommended that couples draw up a prenuptial agreement to protect their legal rights in both countries.

7. Dual Citizenship Status

A Turkish citizen who marries in Montenegro may be eligible to apply for Montenegrin citizenship after marriage. However, the process regarding dual citizenship is subject to the legal regulations of both countries. While Montenegro recognizes dual citizenship in limited circumstances, individuals holding Turkish citizenship may also apply for Montenegrin citizenship.
