DAMAGE COMPENSATION

Damage to vehicles resulting from traffic accidents causes material losses, and the injured party is entitled to compensation for this damage. There are many conditions for traffic accident compensation. The presence of at least one motor vehicle in the accident, and the occurrence of injury or death in the accident, constitute the conditions for compensation in traffic accidents. Damage is not limited to physical harm; damage to property is also included within the scope of damages.

In traffic accidents, the damage can be either minor or major. The greater the extent of the damage, the greater the financial loss.

In traffic insurance, damage compensation is paid to you by the insurance company within forty-five days after all the necessary documents are completed. These documents include: a photocopy of your vehicle registration certificate, a photocopy of your driver's license, an accident report (if it wasn't an accident involving injuries), and photographs of the accident. These documents are sent to the insurance company, and the payment is made to the insured within forty-five days.

Motor insurance coverage is categorized into three main groups: property damage, bodily injury, and death.

WHEN CAN COMPENSATION FOR DAMAGES BE CLAIMED IN A TRAFFIC ACCIDENT?

In traffic accident compensation claims, vehicle documentation is also important. Missing documentation can negatively impact the process in traffic accident compensation lawsuits.

In damage compensation claims, the report showing the decrease in vehicle value is considered more important than other documents. When a compensation lawsuit is filed following a traffic accident, the vehicle owner suffers financial loss due to the decrease in the vehicle's value. Therefore, those involved in traffic accidents should initiate legal proceedings to recover the damages they have suffered.

Another important point to remember is that if an agreement is reached with the insurance company after the accident, the person's right to compensation ends.

BODILY INJURY COMPENSATION

This is a type of compensation received for bodily injuries sustained in a traffic accident. It is paid to victims of traffic accidents under the coverage for bodily injury included in traffic insurance or comprehensive insurance policies.

The insurance policy states the maximum limit for bodily injury coverage. This limit includes the medical expenses of a person injured in a traffic accident, or the medical expenses incurred by a deceased person before their death.

Losses resulting from disability caused by a traffic accident, or losses resulting from death of a person who died, are calculated according to the individual's circumstances.

In the event of death resulting from a traffic accident, the income of the deceased and then the income of those left without support must be determined. This determination requires detailed documents, particularly population registration records.

HOW TO APPLY FOR COMPENSATION?

Applications for traffic accident damage compensation must be submitted to the main offices of the insurance companies via a notary public or registered mail with return receipt requested. Documents required for a traffic accident damage compensation application include all evidence related to the accident, such as accident reports, camera recordings, and witness testimonies. In addition to these documents, a detailed petition explaining the nature of the claims must also be written. Documents supporting the claim, such as hospital treatment information and invoiced expenses, must also be submitted.

In cases where a person dies as a result of a traffic accident, detailed population registry records are required to clearly identify those who will be deprived of support and to provide inheritance documents. All these documents must be collected and sent to the main center.

If the amount of compensation received as a result of a traffic accident does not satisfy the individuals, they can reapply. If they do not receive a satisfactory result after reapplying, they can go to arbitration or file a lawsuit.

IS APPLYING FOR INSURANCE MANDATORY?

According to the provisions of the Highway Traffic Law No. 2918, it is mandatory to apply to insurance companies. The application must be made before resorting to litigation or arbitration. The company is required to make the payment or respond within fifteen days of the application. If no response is given or payment is not made, the right to file a lawsuit and pursue arbitration arises.

 1. Determine which documents need to be collected according to the type of insurance.

 2 – All collected documents must be complete and accurate.

 3 – The application form must include complete contact information, postal addresses, and telephone numbers.

 4 – The application form must include the IBAN number. Payment cannot be processed and the application will remain pending without an IBAN number.

 5 – Once all the documents listed in the first four points are collected and the application form is prepared completely, these documents are sent by registered mail and payment is received.
