Cybercrimes Related to the Misuse of Bank and Credit Cards

The crime of misuse of bank and credit cards is regulated among the cybercrimes in the Turkish Penal Code. No one can carry out any transaction with a bank or credit card for any reason without the cardholder's benefit, or even if it is in the cardholder's benefit, without knowing whether or not permission has been granted. Those who commit these crimes are punishable (Turkish Penal Code, Article 245/1). It is noted that this cybercrime is not punishable if committed by spouses, between individuals in the same household, or between individuals residing in the same household. A person who produces, purchases, or causes the purchase of a counterfeit bank or credit card, linked to another person's bank accounts, is sentenced to imprisonment for 3 to 7 years and a fine of 10,000 days for the computer crime committed (Turkish Penal Code, Article 245/2). Transactions carried out with a counterfeit or altered bank or credit card will be punishable by imprisonment for 4 to 8 years and a fine of 5,000 days for the computer crime committed with that card (Turkish Penal Code, Article 245/3). Article 245/1 of the Turkish Penal Code involves committing a cybercrime using the cardholder's actual card, while Article 245/3 involves using a completely counterfeit card. Therefore, these are among the cybercrimes that carry the most severe penalties.

Use of Prohibited Programs or Devices in Cybercrimes

A person who produces, imports, ships, transports, stores, accepts, sells, buys, gives to others, or possesses a device, computer program, password, or other security code solely for the purpose of committing cybercrimes or other crimes that may be committed using information systems as a tool, shall be sentenced to imprisonment for one to three years and fined up to five thousand days' worth of judicial fine.
