Camera Recordings in Sports Facilities and the Freedom of Evidence in Criminal Proceedings

1. Introduction

Sports venues are public spaces where thousands of spectators are present simultaneously, and security is a top priority.
Therefore, according to Law No. 6222, the installation of camera surveillance systems is mandatory.

However, the fact that these records both constitute personal data and can be used as evidence in criminal proceedingsraises the issue of balancing the principles of "freedom of evidence" and "privacy of private life."

This article the legal basis, evidentiary value, issues of illegally obtained and the Supreme Court's and GDPR's practices.


2. Legal Basis: Article 5 of Law No. 6222 and Camera Requirement

2.1. 6222 m. 5 – Camera System Obligation

"It is mandatory to install a camera system capable of monitoring spectator entry and exit in and around sports venues where competitions are held, and to store the recordings for at least one year."

This regulation aims to protect public order in sports venues and identify perpetrators of violent acts.
However, since it also involves the processing of personal data, compliance with the Personal Data Protection Law (KVKK) is mandatory.

2.2. Club and Federation Responsibility

Clubs and federations are responsible for installing camera systems. The absence of such a system or the deletion of recordings can result in both administrative fines and the failure of investigations due to lack of evidence


3. Freedom of Evidence in the Context of Criminal Procedure

3.1. CMK Article 217

“A judge delivers his verdict only on the basis of the conviction reached after discussing the evidence in court. The alleged crime can be proven by any kind of evidence.”

This article of freedom of evidence ; that is, the type of evidence cannot be predetermined.
However, that the evidence be obtained lawfully (Code of Criminal Procedure, Article 206/2-a).

3.2. CMK Articles 134–138: Electronic Data and Communication Records

Since camera recordings are electronic data, the manner in which they are obtained and stored is subject to review within the framework of Articles 134 and 138 of the Code of Criminal Procedure.
The legality of the evidence is evaluated both the method of its acquisition and its intended use .


4. The Role of Camera Recordings in Criminal Justice

4.1. Incident Detection and Perpetrator Identification

In "field incident" or "incitement to violence" crimes committed under Articles 17 and 18 of Law No. 6222, the most effective evidence is camera recordings.
Supreme Court of Appeals, 7th Criminal Chamber, Case No. 2020/2412 E., Decision No. 2021/734 K.:

"The fact that the defendant is seen throwing a bottle at someone else in the stadium camera footage is sufficient for conviction under the principle of sufficiency of evidence."

4.2. Camera Recordings as Supplementary Evidence

Simply having the records is not enough; the identification of the person in the records must be supported by facial recognition or witness statements.
Otherwise, according to the principle that "the defendant benefits from the doubt," an acquittal will be granted.


5. The Personal Data Aspect of Camera Recordings

5.1. Legal Basis within the Scope of Articles 5-6 of the Personal Data Protection Law

Camera footage is personal data because it contains identifying information.
Processing this data is lawful only under the following circumstances:

  • Legal obligation (Article 5 of Law No. 6222),

  • Ensuring public safety,

  • Fulfillment of a legal obligation.

Therefore, it is prohibited for clubs or federations to use these records for commercial purposes (violation of GDPR).

5.2. Retention Period and Deletion Obligation

According to Law No. 6222, camera recordings must be stored for at least one year . Club managers may be held liable under Article 257 of the Turkish Penal Code (negligence of duty) for data deleted before this period expires


6. Status of Records Obtained Illegally

According to Articles 206/2 and 217/2 of the Code of Criminal Procedure:

"Evidence obtained illegally cannot be used as the basis for a judgment."

Supreme Court Criminal General Assembly, Case No. 2015/370 E., Decision No. 2017/24 K.:

"Camera footage or secret recordings obtained by unauthorized persons constitute a violation of privacy and therefore have no evidentiary value."

Therefore, footage recorded by fans with their mobile phones, other than stadium cameras, the legal requirements .


7. Supreme Court Case Law

7.1. Supreme Court 19th Criminal Chamber, Case No. 2021/1351, Decision No. 2022/1194.

"Since the gym's camera footage was requested by judicial authorities and received sequentially, the evidence is legally admissible."

This decision emphasizes the principle of chain of custody

7.2. Supreme Court 7th Criminal Chamber, Case No. 2020/1742, Decision No. 2021/654.

"If camera footage alone is not sufficient for conviction, it must be supported by witness testimony and expert reports."

The Supreme Court accepts camera recordings as supplementary evidence


8. Constitutional Court Jurisprudence: “Balance Between Privacy and Evidence”

Constitutional Court, Mehmet Ali Aydın Decision (2013/9343):

"Recording images in public spaces constitutes an interference with privacy; however, if there is a legal basis and a legitimate purpose, there is no violation of proportionality."

This decision establishes that camera systems in the implementation of Law No. 6222 must be based on the principles of legitimate purpose and proportionality


9. Chain of Custody in Sports Fields

For a camera recording to be valid in court:

  1. The registration date and time must be verifiable

  2. Sealing the recording media,

  3. The existence of a chain delivery receipt,

  4. The copy and the original image must match
    .

Otherwise, the defense could object, arguing that "the integrity of the evidence has been compromised.".


10. The Conflict Between the Right to Privacy and Freedom of Evidence

Adherence to the principle of "cameras in visible places" in sports venues is consistent with the guarantee of private life enshrined in Article 20 of the Constitution.
Hidden camera recording or filming of personal areas (locker rooms, toilets, VIP boxes) is strictly prohibited.

Supreme Court 12th Criminal Chamber, Case No. 2019/3241, Decision No. 2020/1293:

"Having cameras in the locker room constitutes a violation of privacy under Article 134 of the Turkish Penal Code."


11. Data Control and Administrative Sanctions

In the decision numbered 2020/507 of the Personal Data Protection Board:

"The absence of lighting information and visual warnings for cameras in sports facilities constitutes a data processing breach."

Therefore, the clubs:

  • Placing signs in camera areas that read "This area is monitored by video,"

  • Creating a data processing inventory ,

  • a data destruction policy .


12. Problems in Practice and Proposed Solutions

  1. Poor image quality: Expert examination becomes difficult; high-resolution cameras should be mandatory.

  2. Deletion of records: Administrative penalties should be increased for data deleted before the end of one year.

  3. Sharing evidence: An automated data transfer system should be established between the Turkish Football Federation (TFF) and the prosecutor's offices.

  4. GDPR compliance audits: An independent audit system should be established for federations and clubs.


13. Conclusion

Camera recordings serve both as a preventative security tool and as evidence in criminal proceedings within sports law. However, for this evidence to be valid, a three-pronged balance is essential:

  1. Lawful acquisition,

  2. Chain delivery and integrity,

  3. Personal data protection.

The precedents set by the Supreme Court and the Constitutional Court demonstrate that the freedom of evidence is not absolute, but is limited by the principles of legality and proportionality . Consequently, camera systems in sports facilities are not only a security tool but also a source of evidence that gives rise to legal responsibility.
